DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES SEPTEMBER 23~ 2002 CITY OF KITCHENER The Development and Technical Services Committee met this date commencing at 7:05 p.m. under Councillor B. Vrbanovic, Vice-Chair, with the following members present: Mayor C. Zehr and Councillors M. Galloway, G. Lorentz and J. Smola. Officials Present: Ms. L. MacDonald, Ms. J. Billett and Messrs. J. Fielding, G. Stewart, R. Browning, J. Willmer, B. Sloan, D. Mansell and G. Borovilos. 1. DTS-02-200 14 CHURCH STREET DEMOLITION CONTROL APPLICATION DC 021081CISV ST. MATTHEWS LUTHERAN CHURCH WEST-VICTORIA PARK WARD The Committee was in receipt of Development and Technical Services Department report DTS- 02-200 dated September 9, 2002 dealing with an application to demolish a single detached dwelling known municipally as 14 Church Street. On motion by Councillor M. Galloway - it was resolved: "That Demolition Control Application DC 02/08/C/SV (St. Matthews Lutheran Church), requesting approval for the demolition of one single detached dwelling located at 14 Church Street, legally described as Part of Lot 5, Plan 394 and Part of Lots 2 and 3, Registered Plan 58R-6349, be approved. It is the opinion of this Committee that approval of this application is proper planning for the City." 2. DTS-02-195 DESIGN BALZER GREENWAY COUNTRY HILLS EAST SUBDIVISION 30T-86035 RETENTION OF ENGINEERING CONSULTANT & CONSTRUCTION RE CULVERT The Committee was in receipt of Development and Technical Services Department report DTS- 02-195 dated September 6, 2002 dealing with retainment of an engineering consultant to undertake design and construction of the Balzer Creek Culvert. On motion by Councillor M. Galloway - it was resolved: "That the City's consultant selection procedure be waived and Stantec Consulting Limited be retained as the City's Engineering Consultant to undertake the design, tender and contract administration for the construction of the Balzer Creek Culvert, Country Hills East Subdivision 30T-86035 (Drewlo Investment Inc.)." DTS-02-208 STRASBURG ROAD, HURON BUSINESS PARK FINANCIAL IMPLICATION OF EXTENSION OF A PUBLIC ROAD FROM STRASBURG ROAD THRU SITE 164 The Committee was in receipt of Development and Technical Services Department report DTS- 02-208 dated September 16, 2002 detailing financial implications relative to a proposal for extension of a public road from Strasburg Road to the rear of Site 164 within the Huron Business Park. Mr. Richard Hardie, Richard A. Hardie & Associates Inc., was in attendance this date to answer questions. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES SEPTEMBER 23~ 2002 - 165 - CITY OF KITCHENER 3. DTS-02-208 STRASBURG ROAD, HURON BUSINESS PARK FINANCIAL IMPLICATION OF EXTENSION OF A PUBLIC ROAD FROM STRASBURG ROAD THRU SITE 164 (CONT'D) On motion by Councillor M. Galloway - it was resolved: "That Development and Technical Services Department staff not proceed with a proposal to extend a public road from Strasburg Road to the rear of Site 164 for the purpose of subdividing a 12.5 acre parcel of land into smaller parcels within the Huron Business Park." PRESENTATION - REGION OF WATERLOO FIRST RESPONSE PROTOCOL Mr. Steve LaRochelle, Planning Associate and Ms. Margaret Verbeek, Emergency Planning Co- ordinator, Region of Waterloo Social Services, attended with respect to a First Response Protocol Program identified as a supplementary program to the Region's Social Services Emergency Response Plan and which is intended to provide assistance for up to 50 displaced persons as a result of smaller scale emergency situations. It was noted that the Region's Social Services partners with the Red Cross, the Waterloo Regional Police Services and local Fire in administering this program. Mr. LaRochelle provided an overhead powerpoint presentation illustrating the type of assistance provided during emergencies, including immediate shelter and personal support needs; protocol procedure undertaken during an emergency; the roles undertaken by Social Services, Red Cross, Police and Fire; members of the Emergency Response Team; the debriefing process; and 2002 statistics detailing numbers of persons receiving assistance under the program for various emergency situations occurring within Kitchener. Mr. LaRochelle and Ms. Verbeek then responded to a number of questions concerning availability of late night Grand River Transit (GRT) service, language barriers, availability of emergency personal care items such as blankets and pillows and a recent Provincial Government proposal to implement community emergency response teams. During discussion it was noted that GRT buses are available to provide shelter on a 24 hour / 7 day per week basis through an emergency dispatch service; Social Services is currently exploring provision of translation services with existing contacts on record with the Waterloo Regional Police Services and the Multicultural Centre; and are also working with the Red Cross to utilize its contact resources for emergency personal care provisions. Councillor B. Vrbanovic suggested that a flyer be prepared in languages prevalent within this community detailing the assistance provided under the First Protocol Response Program. Ms. Verbeek agreed that this would be appropriate to assist in bridging language barriers. Ms. Verbeek also addressed the Provincial Government proposal to implement community emergency response teams, noting that as a result of Bill 148 funding is being set aside to undertake pilot projects within eight municipalities; however, information respecting eligibility criteria and funding disbursement is limited at this time. Councillor B. Vrbanovic thanked Mr. LaRochelle and Ms. Verbeek for their presentation. DTS-02-207 90 WOODSlDE AVENUE MOE CERTIFICATES OF APPROVAL The Committee was in receipt of Development and Technical Services Department Report DTS- 02-207 dated September 17, 2002 in response to direction given to staff at the August 12th Development and Technical Services Committee meeting to prepare a report in consideration of requests outlined by Ms. Heather Thompson respecting deletion of the temporary use provision at 90 Woodside Avenue, continuation of consultation with area residents on matters concerning the subject property and development of external / internal protocol procedures regarding the Ministry of Environment's (MOE) Environmental Bill of Rights Registry (EBRR). DTS-02-207 90 WOODSlDE AVENUE MOE CERTIFICATES OF APPROVAL (CONT'D) Mr. Brandon Sloan was in attendance to address the staff report and advised that the appeal period has expired respecting the M©E decision to consider Certificate of Approval applications by General Environmental Group (GEG) to have been withdrawn, with no appeal having been filed by GEG. Accordingly, he advised that the M©E's file is now officially closed. Mr. Sloan then reviewed the three part recommendation detailing staff's reasons for recommending no action be taken regarding the temporary use provision, a proposal to make written requests to the M©E to take certain actions respecting Certificate of Approval applications located in Kitchener and an internal process to monitor the M©E's EBRR, all as outlined in report DTS-02-207. In response to Mayor C. Zehr, Ms. L. MacDonald advised that staff have no knowledge of GEG's future plans for the site and following further discussion, Mr. G. Stewart agreed that staff would undertake to monitor this site. Councillor G. Lorentz also suggested that City departments be requested to monitor all types of incoming applications and apprise Council of any application received involving 90 Woodside Avenue. In response to Councillor B. Vrbanovic, Mr. J. Willmer advised that the time estimated for staff review of the M©E's EBRR relates primarily to any follow-up research required in determining if an application listed is of particular concern that would require notification to Council. On motion by Councillor G. Lorentz - it was resolved: "a) That no action be taken regarding the existing Temporary Use Provision 8T in Zoning By-law 85-1 that affects the property municipally known as 90 Woodside Avenue. b) That Planning Services, in consultation with Legal Services, develop a letter to be sent by the City to the Ministry of Environment (MOE) requesting the following actions be undertaken for any Certificate of Approval application located in the City of Kitchener: 1) that the proponent be directed to make the application through the M©E District Office in Guelph; 2) that the M©E ensure that proper documentation is provided with the Certificate of Approval application to: a) confirm that the proponent has conducted adequate public notification, including notification of all residential or institutional property owners within 120 metres of a proposal site; and, b) confirm that the proponent has contacted and received clearance from the City of Kitchener that the proposed land use is permitted in the Zoning By-law; and 3) that the M©E contact the City of Kitchener General Manager of Development & Technical Services and the Regional Municipality of Waterloo Commissioner of Planning, Housing and Community Services should the M©E in its initial review determine that a specific proposal may have major land use incompatibility and/or significant effects on residential areas. c) That the General Manager of the Development & Technical Services (DTS) Department assign one staff person in the DTS Department to immediately begin reviewing the M©E's Environmental Bill of Rights Registry (EBRR) and further investigate the need to develop an internal protocol or policy on handling Certificate of Approval or other environmental applications." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES SEPTEMBER 23~ 2002 - 167 - CITY OF KITCHENER 6. PROVINCIAL GOVERNMENT TAX INCENTIVE ZONE PILOT PROGRAM Councillor B. Vrbanovic referred to the recent launching of the Provincial Government Tax Incentive Zone Pilot Program, requesting that staff investigate criteria eligibility and report back to Council on the feasibility of the City submitting an Expression of Interest prior to the Province's deadline of October 18, 2002. DTS-02-193 - UPDATE REGARDING STATUS OF TWO UNFINISHED BUSINESS ITEMS °:° REVIEW OF HERITAGE IMPACT ASSESSMENT PROCESS °:° NEW LOCATION FOR LOG HOUSE REMOVED FROM PIONEER TOWER ROAD 146 The Committee was in receipt of Development and Technical Services Committee information report DTS-02-193 which addresses the status of two unfinished business items respecting review of the Heritage Impact Assessment process and the relocation of the log house removed from 146 Pioneer Tower Road. Further reports are expected to be brought forward to the Development and Technical Services Committee respecting these two items in December 2002.
