BACKGROUND: The subject property is located on the north side of Hidden Valley Road backing onto Highway 8. The property currently contains a single detached dwelling that has been acquired by the Ministry of Transportation for highway right-of-way purposes, necessitating the need for demolition control. The lands surrounding the subject property are single detached residential properties and a block of agricultural land. The applicant is proposing to demolish the dwelling in order to accommodate the widening of Highway 8 including hillside embankments. The lands are currently designated Low Rise Residential in the Municipal Plan and are zoned Residential Two (R-2) with Special Regulation Provision 185R. REPORT: 1. Notification Since there is no right of appeal for demolition control applications, this application was not circulated to the public for comment, however, as a courtesy and for information purposes, this report will be circulated to property owners within 60 metres of the subject property. 2. Planning Comments Under the Planning Act, the purpose of Demolition Control is to maintain residential properties within the municipality and to prevent their premature or unjustified removal. Where no new building permits will be issued for a new building on the site, seven criteria outlined in Council Policy 1-1010 are used to evaluate the appropriateness of an application to demolish a residential building. In this situation the property was not evaluated against the criteria in Council Policy 1-1010 as the dwelling is required to be demolished in order to facilitate the widening of Highway 8. Under this circumstance, the demolition is in keeping with the intent of Council Policy 1-1020 - Demolition of Buildings for a Public Work. 3. Comments Received No comments received. 4. Summary Having considered the circumstance of this demolition request and the intent of Council Policy 1-1020, and having considered that the owner will be using this land in conjunction with highway improvements, Planning Staff are satisfied that the proposed demolition is justified and necessary. As such, Planning Staff recommend that demolition control application DC 06/1 O/H/L T requesting permission to demolish one single detached dwelling located at 542 Hidden Valley Road, legally described as Lot 10, Registered Plan 1523, be aooroved, without conditions.
