RECOMMENDATION:
Joseph Street/Gaukel Street Reconstruction, City of Kitchener
- Noise By-law Exemption
That the City of Kitchener and its contractor(s) be exempt from the provisions of Chapter 450
Noise of the City of Kitchener Municipal Code Article 6 Construction Work during the Road
Reconstruction on Joseph Street and Gaukel Street, City of Kitchener. The request for the
noise by-law exemption is between the hours of 7:00 p.m. to 7:00 a.m. for the period from July
6, 2006 to October 30, 2006.
BACKGROUND:
Under the City of Kitchener Contract No. 06-010 the limits of construction for this reconstruction
project include: Joseph Street from Water Street to Queen Street, Gaukel Street from Joseph
Street to King Street and Richmond Avenue from Joseph Street to the limit.
REPORT:
The limits of construction for this request for a noise exemption are on Joseph Street from
Water Street to Queen Street and Gaukel Street from Joseph Street to King Street in the City of
Kitchener. This project began in April 2006 and is scheduled to continue to approximately
October 2006.
The scope of the contract includes the road reconstruction on Joseph Street and Gaukel Street
and Richmond Avenue in the City of Kitchener.
The request for the noise exemption stems primarily for the removal of coal tar and materials on
the job site. Working at night will remove the closest receptor (CDI), and will greatly reduce the
number of people in the downtown core that could potentially be affected by odours. In addition,
cooler temperatures will help reduce the volatilization of the coal tar compounds into the air.
During the excavation of coal tar contaminated soil in support of the Joseph and Gaukel Street
reconstruction project (T06-01 0), the contractor exposed part of a large underground storage
tank that was once part of the coal gasification system in the former City of Kitchener Coal
Gasification Plant on Gaukel Street.
The work to remove the Gasometer Tank and its contents will be a very difficult and meticulous
operation. It is expected that the removal of the Gasometer Tank and its contents will take
approximately 7-10 days. This is tentatively scheduled to be completed from July 10 to July 24,
2006. Throughout the operation, odour control methods will be employed, but it is still expected
that odour and/or air quality will be an issue. Subsequently, it is preferable that the contractor
be permitted to work through the evenings and nights, as appropriate.
Working through the nights will help to expedite the removal operation and minimize the time
where it is expected that the odour issues will be at their worst. Working at night also result in
the expected odours having a lesser impact on the public - Region of Waterloo GRT staff at the
Terminal and CDI College since there will not be as many people in the immediate area as there
is during the day. In addition, the cooler night time temperatures will help to reduce the
volatilization of the coal tar compounds into the air.
Typical construction noise will be generated after the specified by-law hours due to the
timeframe required to perform this work.
The request for a noise exemption will permit the contractor(s) to complete their work in a safe
and efficient manner under the limit set out in the contract. Additional dates may be required
under this contract and this exemption will address any unforeseen issues. In order to limit the
impact on the nearby residential areas, the contractor will be required to comply with
requirements for equipment maintenance and operation, in that the contractor is obligated to
maintain all equipment in proper working order including proper noise reduction.
FINANCIAL IMPLICATIONS:
None.
CONCLUSION:
In order to expedite the construction, reduce adjacent property issues and allow extended hours
of work to take place for this project, thereby minimizing traffic impacts on the City's Streets, we
recommend that this request for a noise by-law exemption be granted.
