APPEAL - CHIP WAGON LOCATION - 2191 KINGSWAY
DRIVE
RECOMMENDATION:
The Committee's direction is requested.
BACKGROUND:
By-law 2004-258 requires a 200-metre distance separation between a Refreshment Vehicle and
a Place of Refreshment and a 400-metre distance separation between two Refreshment
Vehicles. This requirement is for both new and renewal applications.
In May of 2003 an appeal to locate a hot dog cart was before Council for the above location. At
the time the Franklin Street bridge was under construction and several businesses in the vicinity
voiced their concerns with the request. Council refused the appeal noting that there were
hardships that area businesses were experiencing due to the construction. Council agreed that
the situation would be reviewed the next year once the construction had been completed.
There were no requests for a Refreshment Vehicle at 2191 Kingsway Drive in 2004. Therefore,
the situation was not reviewed in 2004.
REPORT:
Attached is a letter from Nisar Ali Jafferi requesting an appeal of the Manager of Licensing's
decision not to issue a licence for the operation of a Chip Wagon at the above address. He has
received permission from the owner of 2191 Kingsway Drive to be located outside of his variety
store.
There are currently three Places of Refreshment within the distance separation. All have been
notified of this request. The Places of Refreshment that expressed their concerns in 2003 have
also been notified of this request.
FINANCIAL IMPLICATIONS:
None
COMMUNICATIONS:
The businesses within the distance separation have been notified of this request as well as
those that expressed concerns in 2003.
