REQUEST TO RELOCATE A CLASS D ADULT
ENTERTAINMENT PARLOUR
RECOMMENDATION:
Council's direction is requested.
BACKGROUND:
Attached is a letter from Randy Zivkovic owner of the Taj Mahal Adult Entertainment
Parlour requesting Council's approval to move his Class 0 Adult Entertainment Parlour
from 8-808 Courtland Avenue East to 37 Bruce Street in Kitchener.
REPORT:
By-law 2004-271 has established locational criteria to substitute a new location for an
existing Class 0 entertainment parlour or to add a new Class 0 adult entertainment
parlour location. A report is to be made to Council with respect to compliance of such a
request with all the provisions of the Chapter and any exisitng uses, in addition to the
uses in Section 27 (which is the locational criteria) within 100 metres of the new
location.
A recent inspection of 37 Bruce Street indicates that it meets all the locational criteria of
the by-law except for provision (h) of Section 27 which reads "the lands upon which the
Class 0 adult entertainment parlour is located shall not be within 400 metres of any
M4(Heavy Industrial) zone..." There are lands zoned M4 within 205.92 metres of this
property. There are also several residential properties within 100 metres of this
property's sideyard separated by the the on-ramp to the Conestoga expressway.

There is also a commercial plaza directly across the street whose tenants include
Burger King, Little Short Stop, Kim King Restaurant and the Paper Factory.
