Riordan January 10, 2005 CRPS-05-010 LAND TRANSFER AND CONVEYANCE OF AN EASEMENT TO THE REGIONAL MUNICIPALITY OF WATERLOO - KILKERRAN CRESCENT RECOMMENDATION: That the parcel of land municipally known as 103 Kilkerran Crescent, previously described as part of Blocks 131 and 132 of Registered Plan 1640 in the City of Kitchener, more particularly described as Parts 1, 2 and 3 on draft reference plan dated November 12, 2003 prepared by McKechnie Surveying Limited be declared surplus for the purposes set out below; and, That Legal Services be directed to transfer said Parts 1 and 2 to the Regional Municipality of Waterloo for the continued operation of Well K-36 located on the lands, at market value, plus incidental costs associated with this transaction; and further, EXECUTIVE SUMMARY: n/a That Legal Services be directed to convey an easement over said Part 3 to the Regional Municipality of Waterloo for vehicle access to Part 1. BACKGROUND: n/a REPORT: The Regional Municipality of Waterloo has expressed interest in acquiring land on the reference plan yet to be registered for the continued operation of Well K-36 and the culvert located on the lands. The Region also has an interest in obtaining an easement over Part 3 for occasional vehicle access to do maintenance on their culvert at the rear of Part 1. Part 3 is presently used as a trail that leads to an open space area (Strasburg Creek) and the community trail system within a woodlot. .. ./2 - 2 - A letter of opinion satisfactory to the City Solicitor has been obtained from Coldwell Banker, Peter Benninger Realty indicating a market value of Part 1 being $350.00 and $25.34 for Part 2. The land is considered to be wetland and only provides for a pump house. Property Management Committee recommends that the land be declared surplus and Parts 1 and 2 be transferred to the Region along with an easement over Part 3. FINANCIAL IMPLICATIONS: All costs of registration of easement to be paid by Regional Municipality of Waterloo. All other incidental costs relating to the sale will also be recovered.
