HomeMy WebLinkAboutCRPS-05-019 - Encroachment Agmt Request - 64 Benton St. ~ Report To: Date of Meeting: Submitted By: Prepared By: Ward(s) Involved: Date of Report: Report No.: Subject: Mayor and Members of Council January 31, 2005 Jennifer Sheryer Assistant City Solicitor Jennifer Sheryer Assistant City Solicitor Ward 6 January 19, 2005 CRPS-05-019 ENCROACHMENT AGREEMENT REQUEST-64 BENTON ST FOR LANDSCAPING AND SERVICING ACCESS PIT RECOMMENDATION: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the property owner of Part Lots 10 to 15, Registered Plan 394 designated as Parts 1 and 2 on Reference Plan 58R-14389, municipally known as 64 Benton St., to legalize the existing encroachment of landscaping and servicing access pits onto City property. " REPORT: I am in receipt of a request to legalize existing landscaping and servicing access pits located on City property. The encroachments are substantially as a result of a road widening taken by the City for this property as required by Schedule "0" of the City's Municipal Plan. Prior to the road widening, the landscaping and servicing access pits were not encroaching on City land as they were all located on the subject property. FINANCIAL IMPLICATIONS: N/A COMMUNICATIONS: N/A CONCLUSION: The appropriate staff has reviewed this request and has no concerns with the location of the existing landscaping and servicing access pits.
