HomeMy WebLinkAboutCRPS-05-023 - Proposed closure of Karn Lane between Belmont Ave W and Patricia Ave ~ Report To: Date of Meeting: Submitted By: Prepared By: Ward(s) Involved: Date of Report: Report No.: Subject: Development & Technical Services Committee February 14, 2005 Fiona McCrea (ext. 2266) Fiona McCrea West - Victoria Park Ward 6 February 4, 2005 CRPS-05-023 Proposed closure of Karn Lane, between Belmont Avenue West and Patricia Avenue, Kitchener RECOMMENDATION: "That Legal Services be directed to proceed with the preparation and advertising of the closure and conveyance of Karn Lane, between Belmont Avenue West and Patricia Avenue and described as Parts 1 to 4 on Plan 58R-5165, conditional upon obtaining an appraisal of the fair market value and offer to purchase for Council's consideration. All costs associated with this proposed closure are to be borne by the prospective purchaser of the property." REPORT: We have received written confirmation from 1471263 Ontario Limited, the new owner of 450 Belmont Avenue West, of its intention to proceed with the closure and acquisition of Karn Lane, described as Parts 1 to 4 on Plan 58R-5165. Further, we are in receipt of written confirmation from the other abutting property owners each indicating they are in support of this closure and have no interest in acquiring any portion of Karn Lane. We have circulated this request to internal staff and external agencies and have received no objection to the proposed closure and we are advised that no services are located on Karn Lane for which a formal easement would be required. It is the prospective purchaser's intent to add the closed portions of this lane to its existing commercial property adjacent to Karn Lane and, to vacant land intended for future residential development it is purchasing in April, 2005. As such, staff recommend that Karn Lane be conveyed to 1471263 Ontario Limited for fair market value and that all costs associated with the proposed closure and conveyance be borne by the prospective purchaser. VALUATION: COMMUNICATIONS: n/a CONCLUSION: Staff recommend that Karn Lane between Belmont Avenue West and Patricia Avenue and described as Parts 1 to 4 on Plan 58R-5165 be closed and conveyed to 1471263 Ontario Limited for fair market value and that all associated costs be borne by 1471263 Ontario Limited.
