HomeMy WebLinkAboutCRPS-05-032 - Signing Authority to General Manager of Development & Technical Services - Agreements for Borehole Testing ~ Report To: Date of Meeting: Submitted By: Prepared By: Ward(s) Involved: Date of Report: Report No.: Subject: Mayor and Members of Council February 28, 2005 Lesley MacDonald, Director of Legal Services and City Solicitor Lesley MacDonald, Director of Legal Services and City Solicitor N/A February 21, 2005 CRPS-05-032 COUNCIL DELEGATE SIGNING AUTHORITY TO THE GENERAL MANAGER OF DEVELOPMENT & TECHNICAL SERVICES TO SIGN ANY FUTURE AGREEMENTS TO PERMIT BOREHOLE TESTING AND INSTALL MONITORING WELLS ON CITY ROAD ALLOWANCES RECOMMENDATION: That Council delegate signing authority to the General Manager of Development & Technical Services, or his designate, to sign on behalf of the City, any future Agreements to permit Borehole Testing, the installation of Monitoring Wells, and/or remediation on City road allowances, provided same are satisfactory to the City Solicitor. BACKGROUND: From time to time the City is approached by an environmental consultant hired by the property owner of a subject property where there is a suspected contamination. In order for the consultants to complete their investigation, it is often necessary to drill boreholes on city road allowances to determine the magnitude of the contamination. REPORT: It is becoming increasingly common for property owners to hire an environmental consultant to determine the extent of any suspected contamination on their property. Once the consultant has done a preliminary investigation, it is often necessary for further investigation to take place and often involves the drilling of boreholes, the installation of monitoring wells to determine the magnitude of the contamination, and in a few cases, the remediation of the City road allowance. In order for the consultant to facilitate the necessary work it is necessary for the property owner to enter into an Agreement with the City of Kitchener to allow for the required activity on City property. The Agreements are for the most part, standard agreements prepared by Legal Services and can generally be prepared shortly after all information has been provided. In order to be efficient and avoid any unnecessary delays, it would be appropriate for these standard agreements to be signed by the General Manager of the Development & Technical Services Department or his designate. FINANCIAL IMPLICATIONS: None. COMMUNICATIONS: Not Applicable. CONCLUSION: In order to facilitate the work, it is necessary for the City of Kitchener to enter into these standard agreements to allow the further investigation to take place. It is to the City's benefit to allow these types of investigations to take place as it allows the City to obtain the report results and where applicable the contaminated property to be remediated at little or no expense to the City.
