FN 2004-003 - 2 CAMROSE COURT, KITCHENER RECOMMENDATION: That the application of Nathan P. Smye (2 Camrose Court) requesting legalization of an existing 1.8m (5.9 ft.) high fence located 0 m from the lot line abutting Highland Crescent (side yard abutting a street) rather than the required 1.5 m (4.92 ft.), on Lot 1, Registered Plan 1623, 2 Camrose Court, Kitchener, Ontario BE APPROVED, subject to the following condition: 1. That the owner shall remove sections of the existing fence to provide a 4.57m (14.99 ft.) corner visibility triangle at the easterly corner of the subject property, where the property abuts Lot 1, Registered Plan 1308, at Highland Crescent. BACKGROUND: The above recommendation was adopted by the Committee of Adjustment at its December 7, 2004 meeting, and forwarded to the Committee of the Whole on December 13, 2004 for ratification. At the December 13, 2004 Committee of the Whole meeting, Councillor Vrbanovic requested this matter be deferred to the January 17, 2005 Council meeting, as it was his understanding the property owner was not in agreement with the Committee of Adjustment decision. Mr. Smye did not attend the January 17, 2005 Council meeting; consequently, the above recommendation has not been ratified by Council. REPORT: Staff have contacted Mr. Smye, the owner of 2 Camrose Court, who has advised he is not opposed to the Committee of Adjustment decision on his fence variance application, and does not wish to appear before Council. He has requested that a member of staff attend at his property to assist him in determining how much of the fence needs to be removed, and arrangements are being made accordingly. Dianne H.
