HomeMy WebLinkAboutCRPS-05-037 - Exemption to Chapter 450 (Noise) - 50 Washburn Drive ~ Report To: Date of Meeting: Submitted By: Prepared By: Ward(s) Involved: Date of Report: Report No.: Subject: Finance and Corporate Services Committee March 7, 2005 Gary Sosnoski, General Manager of Corporate Services and City Clerk Shayne Turner, Director of By-law Enforcement South Ward March 2, 2005 CRPS-05-037 EXEMPTION TO CHAPTER 450 (NOISE) - BASICS OFFICE PRODUCTS AT 50 WASHBURN DRIVE RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Basics Office Products at 50 Washburn Drive, from 6 A.M. on Friday April 15, 2005, to 8:00 A.M. on Monday April 18, 2005, in order to move products into their newly construction warehouse, from their previous location. BACKGROUND: Basics Office Equipment has constructed a new warehouse location at 50 Washburn Drive. The warehouse is scheduled to open for business on Monday April 18, 2005. In order to minimize the interrupption in their service levels to their customers, they are required to move the warehouse products from their existing location in Waterloo to the new location on Washburn Drive. Attached is a copy of their exemption request. REPORT: The warehouse is situated on Washburn Drive, adjacent to the south side of Bleams Road. There is a residential area situated on the north side of Bleams Road. The company has assured City staff that they will take all possible actions to limit the noise associated with the unloading of the trucks. The loading docks are located on the south side of the building, as such they are on the opposite side of the building from that which faces the residential area. Having said this, there is the potential for some impact on the residential area, that being along Rushbrooke Drive, resulting from the unloading process. It should be noted that there was an issue with noise from the original construction of the warehouse, which caused the contractor to apply for a noise exemption in November 2004. There was opposition from the adjacent residential area and the original exemption request was denied. Subsequently, the contractor took steps to mitigate the construction noise and another exemption application was submitted and approved. As part of the 2nd application process, the contractor communicated their actions to the adjacent residents. A public information piece was distributed to the residents thought to be potentially impacted along Rushbrooke Drive. Attached is a copy of the documentation distributed to the residents in the area. FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required.
