SHERATON FOUR POINTS HOTEL RECOMMENDATION: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the property owner of Part Lot 5, Plan 364, Part Lots 4, 6 to 9 and 11, Plan 367, and Part Lot 38, Plan 394, municipally known as 105-131 King St. E., to permit erection of two canopies which overhang the road allowance of King Street E." and "Further that upon execution of this agreement referenced above, the agreement dated July 10, 1972 between The Corporation of the City of Kitchener and Edmund Peachey Limited legalizing the encroachment of a canopy over King Street E. is no longer in force and effect." REPORT: I am in receipt of a request to legalize the construction of two canopies which overhang the King Street E. road allowance. There is an agreement dated July 10, 1972 between The Corporation of the City of Kitchener and Edmund Peachey Limited legalizing a single canopy over King Street E. This canopy has since been replaced and an additional canopy added, for which there is no current encroachment agreement. The owner wishes to replace the existing canopies. It is appropriate to enter into a new agreement in place of the 1972 agreement. FINANCIAL IMPLICATIONS: N/A COMMUNICATIONS: N/A CONCLUSION: The appropriate staff has reviewed this request and supports the legalization of the proposed encroachment.
