APPEAL - HOT DOG CART LOCATION - 640 QUEEN
STREET SOUTH
RECOMMENDATION:
For information purposes.
BACKGROUND:
An application was received to licence a hot dog cart at 640 Queen Street South. The Manager
of Licensing refused the application because it was within the distance separation of another
Refreshment Vehicle. The applicant appealed the decision.
At the Finance and Corporate Services Committee of April 18, 2005 the matter was deferred in
order to obtain more information from the Transportation Planning Division.
REPORT:
Attached is an aerial map of the property submitted by the applicant showing possible proposed
locations for the hot dog cart.
The following concerns were expressed by Mr. Ken Carmichael of Transportation Planning:
· There is insufficient on-site parking for potential customers
· Parking will occur on the adjacent property, which is a part of the Canadian National Railway
right-of-way. Staff have observed significant parking congestion at this location under
existing conditions.
· On-street parking on Queen St. S., or the boulevard or sidewalk within this right-of-way is
not permitted at anytime.
· The access to this site is not wide enough to allow safe two-way traffic entering/exiting
simultaneously.
FINANCIAL IMPLICATIONS:
None
COMMUNICATIONS:
The applicant has been advised of this meeting.
CONCLUSION:
Staff recommends denial of this request at this time for the following reasons:
· Does not comply with By-law 2004-258 (Refreshment Vehicles) due to the distance
separation between this cart and another refreshment vehicle
· Transportation Planning is concerned that the requirements for operating a hot dog cart at
this location cannot be met entirely and safely within the property at 640 Queen St. S.
