Subject: EXEMPTION TO CHAPTER 450 (NOISE) -SHAWN
COOPER, VICTORIA PARK PAVILION
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
Shawn Cooper for album release events to be held at the Victoria Park Pavilion on between the
hours of 7:00 PM and 10:15 PM, on the following dates:
January 5 and 26, February 23, March 9, April 6 and 30, May 11, and June 8, 2007.
BACKGROUND:
Mr. Shawn Cooper of Flamesburn.com is planning to host album release parties for local bands
in the Victoria Park Pavilion on the 8 dates as indicated in the above recommendation, between
the hours of 7:00 PM and 10:15 PM. Attached is a copy of his request.
REPORT
The event organizer, Mr. Cooper, advises that all music for the event will be played inside the
pavilion. In addition, the event is non-licensed with no alcohol being served.
Several similar events have been held earlier this year by the same organizer and the By-law
Enforcement Division is not aware of any concerns raised with regard to noise impacting the
adjacent neighbourhood area.
FINANCIAL IMPLICATIONS:
None identified at this time.
COMMUNICATIONS:
No Corporate Communications required.
CONCLUSION:
Based on the circumstances surrounding these events, the By-law Enforcement Division does
not object to this request for an exemption.
