HomeMy WebLinkAboutAdjustment - 2007-01-16 SGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD JANUARY 16, 2007 MEMBERS PRESENT: OFFICIALS PRESENT: Messrs. D. Cybalski, B. McColl & A. Head. Ms. T. Malone-Wright, Senior Planner, Ms. J. von Westholt, Ms. D. Gilchrist, Secretary-Treasurer, and Ms. R. Brent, Assistant Secretary- Treasurer. Mr. D. Cybalski, Chair, called this meeting to order at 10:00 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, February 5, 2007, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2007-001 Applicant: Jim Tsiloyannis Property Location: 48 King Street West Legal Description: Part dots 1, 2, 5 & 7, Plans 383 & 401, Reference Plan 58R-6201 Appearances: In Support: None Contra: None Written Submissions: None The Committee agreed to the written request of the applicant to defer consideration of this application. The hearing of this application is to be scheduled for Tuesday February 20, 2007. The Committee noted the applicant for Submission No. SG 2007-002 had not arrived and agreed to hear the application at the end of the meeting. 2. Submission No.: SG 2007-002 Applicant: Agata Ar1el Property Location: 274 Frederick Street Legal Description: Part dot 2, Registered Plan 111 Appearances: In Support: Contra: Ms. A. Artel Mr. K. Huryk None Written Submissions: None The Committee was advised that the applicant requests permission to locate a ground sign 0.3m X0.98') from the lot line along Frederick Street rather than the required 3m (9.84'). Submission No.: SG 2007-002 ~Cont'd) The Committee considered the report of the Development & Technical Services Department, dated January 10, 2007 advising they have no objections, provided the proposed sign is located outside of the 4.57 meter driveway visibility triangle and the applicant remove the existing sidewalk in the location of the proposed sign and prepare a landscape plan for the front yard to the satisfaction of the Director of Planning. The existing sidewalk must be removed and the approved landscape plan implemented by June 30, 2007. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated December 28, 2006 advising they have no concerns with this application. Ms. Artel advised that her proposed sign is similar in style, size, and location to other signs on Frederick Street. She noted that because of the adjustment to the front lot line of this property, she hasn't much space in the front yard for a sign. With respect to the conditions requested by staff, she is prepared to remove the sidewalk and provide the landscaping. Moved by Mr. B. McColl Seconded by Mr. A. Head That the application of Agata Artel requesting permission to locate a ground sign 0.3m (0.98') from the lot line along Frederick Street rather than the required 3m (9.84'), on Part Lot 2, Registered Plan 111, 274 Frederick Street, Kitchener, Ontario, BE APPROVED, subject to the following conditions: 1. That the proposed sign shall be located outside of the 4.57 metre driveway visibility triangle. 2. That the owner shall remove the existing sidewalk in the location of the proposed sign by June 30, 2007. 3. That the owner shall submit and receive approval of a landscaping plan for the front yard, to the satisfaction of the Director of Planning, and shall implement the landscaping plan by June 30, 2007. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Sign By-law is being maintained on the subject properly.
