RECOMMENDATION:
Declare Land Surplus to the City's Needs - Property on
Fergus Avenue
In compliance with the Sale of Real Property Procedural By-law 95-61, Section 3 (Chapter 177
of The City of Kitchener Municipal Code) we recommend that Council enact the following
resolution:
"That Lot 196 Streets & Lanes in Kitchener (being part of Solon Avenue) closed by By-
Law 5471, registered as Instrument No. 650644, Part 1 ft Reserve A, Plan 687, Part
Farm Lot Plan 589 as 249123; except Pt 2 658R829 Kitchener be declared surplus to
the City's needs to create a building lot; and,
That Legal Department be directed to prepare an agreement setting out conditions for
development on the said lands as identified; and further,
That Purchasing be directed to issue a sale by tender for the said lands; and

That the Mayor and Clerk be authorized to execute any documentation in this regard
required by and to the satisfaction of the City Solicitor."
DESCRIPTION:
The subject property is described as Lot 196 Streets & Lanes in Kitchener (being part of Solon
Avenue closed by By-Law 5471, registered as Instrument No. 650644, Part 1 ft Reserve A, Plan
687, Part Farm Lot Plan 589 as 249123, except Pt 2 658R829 Kitchener, located on Fergus
Avenue. It is zoned Residential Zone 4 of By-law 85-1. (See appended map)

PURPOSE/REASON:
In an effort to divest the City of surplus lands that can be developed, City staff have proposed to
sell this property on Fergus Avenue.
VALUE:
An appraisal has been obtained and a minimum bid established.
NOTICES TO PUBLIC:
Notice to the public is given by way of listing on the Councilor Committee of Council agenda. In
addition, the tender will be advertised in the K-W Record and the City of Kitchener Internet.
NOTIFICATION TO AGENCIES:
No government agencies abut or surround the subject property; therefore, no agencies were
notified.
METHOD OF SALE:
We are recommending that Purchasing be directed to proceed with a sale by tender for the
lands.
TERMS & CONDITIONS:
The residential lot should be subject to conditions for development. The following conditions are
proposed:
1. That the grading and servicing be reviewed and approved by Building Division staff at
building permit stage;
2. That the buyer is responsible to pay for services to the lot; and,
3. That the Building Division review that the architecture is compatible with adjacent
dwellings on Fergus Ave.
