LOTTERY BREAK OPEN TICKETS - COUNCIL POLICY 1-
880 (ADDITIONAL TERMS & CONDITIONS)
RECOMMENDATION:
That City of Kitchener Council Policy 1-880, Section 1 be amended as follows:
"Licenses and/or permission to sell Break-Open Tickets in the City of Kitchener shall be
granted only to those licensees who have a physical presence in the City of Kitchener
or can justify their charitable benefit to the residents of the City of Kitchener with the
majority of the proceeds from the lottery remaining in the Region and further;
BACKGROUND:
Section 3 be deleted from Council Policy 1-880.
Provincial Regulations permit municipalities to add additional terms and conditions for lotteries
that are operated in their municipality provided the municipality is aware that Provincial Terms
and Conditions take priority over any additional terms and conditions the municipality may pass.
REPORT:
In the month of May several conversations were held with the President of the Cambridge
Memorial Hospital Foundation regarding their organization selling lottery break-open tickets in
the City of Kitchener. The current policy only permits organizations that have a physical
presence in the City of Kitchener to sell break-open tickets in the municipality. Staff reviewed
the current policy and determined that if a charitable or non-profit organization had a physical
presence in the City or could justify to staff that its charitable objectives benefit the residents of
the City of Kitchener it could be considered for licensing purposes. The City of Cambridge has
a policy that is similar to the policy staff is proposing.
During the review, it was determined that Section 3 of Policy 1-880 could be deleted as
Provincial Regulations now require the municipality receive this information before a Break-
Open Ticket Lottery Licence can be issued.
