Gosse, Director of Legislated Services/Deputy City Clerk Patricia Harris, Interim Manager of Licensing June 7,2005 CRPS -05-105 BULL RUN AT KITCHENER PORTUGUESE CLUB -1548 FISCHER HALLMAN ROAD - JUNE 11 & 12, 2005 - LICENSING CONDITIONS RECOMMENDATION: "That Mr. Joe Borges be granted permission to hold a running of the bulls event at the Kitchener Portuguese Club, 1548 Fischer Hallman Rd., on June 11 & 12, 2005 provided the necessary licence is obtained and the following conditions are attached to the required licence: Any Inspector of the Ontario Society for the Prevention of Cruelty to Animals, agent, or employee of a Humane Society must be in attendance throughout the two day event; and Two Waterloo Regional Police officers must be in attendance at all times during the two day event and such officers are to be arranged and hired at the expense of the applicant; and There must be an ambulance on the grounds at all times during the event; and A big animal veterinarian must be on site at all times during the bull run and arranged for and hired at the applicants expense; An agent of the Canadian Food Inspection Agency is entitled to inspect the animals at any time; and; The animal cannot be involved in the event for more than 10 minutes at one time; The organizer of the event must provide a copy of their insurance policy to the City having at least $5,000,000.00 liability; and further That Mr. Joe Borges be granted an exception under Chapter 408.2.13 and be granted an exemption from the Zoning By-law for the purposes of this event. BACKGROUND: Attached is a letter from Joe Borges requesting Council's permission to hold a "running of the bulls" at the Kitchener Portuguese Club, 1548 Fischer Hallman Rd. on June 11 & 12, 2005. He is also requesting an exemption from the Zoning By-law and an exemption from Chapter 408.2.13. His letter indicates that this event is a fundraiser for the Kitchener Portuguese Club with a portion of the proceeds going to support several charities. The Municipal Act in Section 15.8(f) give a municipality the right to impose special conditions on a business in a class, that have not been imposed on all the businesses in that class in order to obtain, continue to hold or renew a licence. Section 408.2.13 (d) provides for exceptions for prohibited or restricted animals provided they are part of the lawful operation of a circus, carnival, performance, exhibition, zoo, or public display. Currently the zoning for this property is B-2 and would not permit this type of event at 1548 Fischer Hallman Road. REPORT: Staff was informed of this event by the K-W Humane Society. They had concerns with respect to the safety of the animals and whether the animals were being cared for properly in this environment. In conversation with the organizer of the event, Mr.Joe Borges, he described the event as follows: An enclosure is built that consists of a 6 foot high steel girded portable fence with plywood at the side to strengthen it. The bull enters the enclosure along with the participants. They taunt and tease the bull until the bull becomes angry and attempts to attack the participants. The participants use umbrellas, etc. to protect themselves from the bull. The bull is tied with a rope and is never let completely loose. The participants involved are individuals who have partcipated in this type of activity on a regular basis and are familiar with the possible dangers. According to Mr. Borges, the general public is not permitted into the enclosure. The K-W Humane Society and staff have concerns with respect to the health and safety of the animals participating in this event and also the safety of the individuals participating in the event and recommend that several conditions be added to the licence if Council approves the request. The Legal Division has advised that an additional condition should be considered to prohibit the serving of alcohol until after the running of the bulls event has taken place. The actual event is to take place at 4:00 p.m. on both days. This condition may help to reduce the possibility of an accident occurring during the event and help to protect both the participants and the spectators at the event. Council may wish to consider adding the following condition: "That in addition to meeting the terms of any conditions on its liquor licence that the applicant ensure that no alcohol is served on the premises between 9:00 a.m. and such time as the actual bull run has been completed on each day of the event."
