McCrea (ext. 2266) Bev Grant-Campbell Ward 1 June 14, 2005 CRPS-05-110 DECLARE SURPLUS TO CITY'S NEEDS PART 2 ON PLAN 58R-14138 AND PERMIT THE CONVEYANCE OF AN EASEMENT TO KITCHENER-WILMOT HYDRO INC. RECOMMENDATION: That Council enact the following resolution: "That the City declare as surplus to its needs vacant land measuring approximately 4.4 metres by 3.8 metres, fronting onto Bingemans Centre Drive in Kitchener and described as Part of Lot 123, German Company Tract, being Part 2 on Reference Plan 58R-14138; and further That Legal Services be directed to transfer a permanent easement to Kitchener-Wilmot Hydro Inc. which is required for a guy wire that is attached to a brace pole (located on the road allowance) which is supporting a distribution pole on the opposite side of the street." BACKGROUND: The requirement for the easement to Kitchener-Wilmot Hydro Inc. was contemplated during the negotiations surrounding the Bingemans Centre Drive project. Accordingly, the said Part 2 was shown on Reference Plan 58R-14138 which was prepared at the expense of Kitchener-Wilmot Hydro Inc. and deposited on August 29,2003. REPORT: The Property Management Team have reviewed and approved the requested location of this easement. FINANCIAL IMPLICATIONS: Kitchener-Wilmot Hydro Inc. have paid for preparation of Reference Plan 58R-14138 and will pay to the City all associated costs of the transfer of easement. COMMUNICATIONS: CONCLUSION: Staff recommends that Part 2 on Plan 58M-14138 be declared surplus to the City's needs to permit the conveyance of a permanent easement to Kitchener-Wilmot Hydro Inc. An appraisal is not required when an easement is being conveyed to a public utility or telephone company. All of which is respectfully submitted by, Fiona M.
