KITCHENER, MIDNIGHT BAR & CLUB / LUCKY MAN RESTAURANT / EXQUISITE RESTAURANT RECOMMENDATION: To amend clause 3 of the Finance and Corporate Services Committee Report of June 20, 2005 by adding the following to the list of conditions in the recommendation: "To operate the premises not primarily as a bar but as a restaurant as submitted to at the City's Finance and Corporate Services Committee meeting on June 13, 2005;" and further, To amend clause 3 of the Finance and Corporate Services Committee Report of June 20,2005 by substituting the following for condition #6 listed in the recommendation: "To abide to a set 40% or less monthly ratio of alcohol sales to gross refreshment sales (in other words, alcohol sales will be limited to 40% of gross refreshment sales)". EXECUTIVE SUMMARY: BACKGROUND: Council considered new information regarding a liquor licence application for the property at 151 King S1. W. in Kitchener at its June 13, 2005 Finance and Corporate Services Committee meeting. At that time Council requested several conditions above and beyond the standard conditions to be added to the liquor licence if the AGCO chooses to issue the liquor licence in spite of Council's opposition to its issuance. REPORT: At the Finance and Corporate Services Committee meeting of June 13, 2005 the applicant's representative informed the Committee that it was the applicant's present intent for the establishment to be a restaurant. Upon review of the list of standard conditions staff noted that the liquor licence ratio submitted in the applicant's original application would no longer be appropriate in light of the applicant's new plans to make this establishment a restaurant instead of a bar. Staff would recommend that the above conditions be added to the conditions set out in the Finance and Corporate Services Committee report dated June 20,2005.
