EXEMPTION TO CHAPTER 450 (NOISE) - CONESTOGA
STUDENTS INC.
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
Conestoga Students Inc. for an outdoor concert at Conestoga College on Thursday September
15, 2005, between the hours of 7 PM and 11 PM.
BACKGROUND:
Conestoga Students Inc. is planning an outdoor concert on Thursday September 15th, in the
parking lot of Conestoga College. There will be a live band playing, thus there is the potential
for loud noise. As such, the organization has applied for an exemption to Chapter 450 (Noise).
A copy of their request is attached.
REPORT:
The organzers have provided a site plan map to show that the event is being held in a parking
lot that is located a distance from any adjacent residential area. I addition, they will be
positioning the stage to direct the music away from any residential area. The organizers have
also agreed to hand out a flyer to the closest of the residential dwellings providing some
advance notice of the 4 hour event.
There is no record of such an event previously being held by this group or at this location. As
such, staff are not able to comment on any previous issues.
FINANCIAL IMPLICATIONS:
None identified at this time.
COMMUNICATIONS:
No Corporate Communications required.
CONCLUSION:
Based on the circumstances surrounding this event, the By-law Enforcement Division is not in a
position to object to this request for an exemption.
