HomeMy WebLinkAboutCRPS-05-137 - Sign By-law - Municipal Act, 2001 Compliance Review ~ Report To: Date of Meeting: Submitted By: Prepared By: Ward(s) Involved: Date of Report: Report No.: Subject: Committee of the Whole September 19, 2005 Jennifer Sheryer Jennifer Sheryer All September 13, 2005 CRPS-05-137 SIGN BY-LAW - MUNICIPAL ACT, 2001 COMPLIANCE REVIEW RECOMMENDATION: That The Corporation of the City of Kitchener hereby requests the Regional Municipality of Waterloo to enact a sign by-law effective December 31, 2005 with provisions mirroring those of the City of Kitchener's sign by-law to apply in the geographic limits of Kitchener to the 800 meter corridors along Regional roads in which the Region has authority to enact sign by-laws; and further, That The Corporation of the City of Kitchener hereby requests that the Regional Municipality of Waterloo provide that enforcement of the above-mentioned by-law may be by municipal law enforcement officers / by-law enforcement officers appointed by the Council of The Corporation of the City of Kitchener with any fine revenue resulting from such enforcement to be retained by Kitchener; and further, That The Corporation of the City of Kitchener hereby requests that the Regional Municipality of Waterloo permit the above-mentioned by-law provisions applying within the geographic limits of the City of Kitchener to be administered by staff of The Corporation of the City of Kitchener at the expense of The Corporation of the City of Kitchener with Kitchener to retain any resulting revenue. EXECUTIVE SUMMARY: BACKGROUND: REPORT: The Municipal Act, 2001 requires the City's by-laws to be brought into compliance with its provisions by January 1, 2006. As part of our ongoing compliance review staff has requested the Region to assist in enactment of the new by-law. Regional staff has suggested a formal resolution of Council requesting the Region's assistance in this matter would be in order. FINANCIAL IMPLICATIONS: All costs associated with the administration, enforcement and prosecution of the portions of the Regional Municipality of Waterloo's by-law applying within the geographic limits of the City of Kitchener will be covered by the City of Kitchener. The City of Kitchener will continue to receive revenue (including permit and fine amounts) under the portions of the by-law applicable within the geographic limits of the City. The City currently administers, enforces and prosecutes under the sign by-law applicable to these areas of the City and no substantial cost difference is anticipated. COMMUNICATIONS: A copy of this report has been circulated to staff of the Regional Municipality of Waterloo. CONCLUSION: Jennifer Sheryer, Assistant City Solicitor
