ENCROACHMENT AGREEMENT REQUEST - PROPOSED
FENCE, CORNER OF WILDERNESS DR. AND MOUNTAIN
MINT CRES. AT 154 WILDERNESS DR.
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory
to the City Solicitor, with the property owner of Part Block 12 on Registered Plan 58M-15
designated as Part 61 on 58R-1 0621, municipally known as 154 Wilderness Drive, to legalize
the installation of a 3' high pressure treated wooden fence at the corner of Wilderness Drive and
Mountain Mint Crescent which will encroach approximately 4m along the Wilderness Drive road
allowance and approximately 4m along the Mountain Mint Crescent road allowance."
REPORT:
I am in receipt of a request to legalize a proposed 3' high pressure treated wooden fence which
would encroach approximately 4m along the Wilderness Drive road allowance and
approximately 4m along the Mountain Mint Crescent road allowance. The owner of 154
Wilderness Drive are experiencing a number of problems with the super mailbox located
adjacent to their property on the Mountain Mint St. boulevard. One major problem is local
residents are cutting across their lawn to get to the mailbox and dogs are defecating on their
property as the owners are picking up their mail. The owners would like to try to eliminate these
particular problems by building a fence on their property. A portion of the proposed fence at the
corner of their property would be located on the City's road allowance.
A request has been circulated to appropriate City departments for their inspection and reply.
The Enforcement Division has no objection to the request to legalize the proposed fence. The
Zoning Division and Traffic and Parking Division support the request to legalize the proposed
fence as long as the fence does not exceed 3' in height. Canada Post has also been circulated
and has no concerns with the proposed fence.

CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with the location and
installation of the proposed 3' high pressure treated wooden fence.
