RECOMMENDATION: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of Lot 38, Registered Plan 58M-135, municipally known as 408 Hearthwood Drive, to legalize the installation of an 8' wooden fence to be located approximately 2.5m, more or less, onto an easement registered as Instrument Number L T38127, commencing at the rear lot line stopping at the front building wall, said Agreement to be registered on title." REPORT: I am in receipt of a request to legalize a proposed 8' wooden fence to be located approximately 2.5m, more or less, onto a storm sewer easement registered as Instrument Number L T38127. The fence will commence at the rear lot line and will stop at the front building wall. Engineering Services has no objection to the installation of the proposed fence over the easement. They have noted that the sewer is concrete encased and is approximately 5m deep. Engineering Services advised that if the fence needs to be removed in order to perform any work on the sewer, it is the homeowners' responsibility to pay and arrange for removal of the existing fence and installation of a replacement fence. FINANCIAL IMPLICATIONS: NIA COMMUNICATIONS: NIA CONCLUSION: The appropriate staff has reviewed this request and has no concerns with the location of the proposed 8' wooden fence.
