Subject: ENCROACHMENT AGREEMENT REQUEST FOR
PROPOSED PROJECTING SIGNS AT 286 DUKE ST W
OVER DUKE ST W AND BREITHAUPT ST ROAD
ALLOWANCES
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory
to the City Solicitor, with the property owner of Part Lot 221, Plan 376 designated as Part 1 on
58R-9291 (PIN 22319 0168}, municipally known as 286 Duke St. W., to legalize the proposed
projecting signs which will encroach approximately .66 metres, more or less, into the Duke St.
W. and Breithaupt St. road allowances."
REPORT:
The owner of 286 Duke St. W. operates a new art studio at this location. She wishes to install
two projecting signs on the building, both perpendicular to the street to allow people to see the
business while approaching the building. There is a sign proposed for the Breithaupt St. side of
the building and a sign proposed for the Duke St. W. side of the building. A sketch is attached
illustrating the sign locations. The building is located directly at the property line which results in
the proposed signs being located over the Duke St. W. and Breithaupt St. road allowances. The
proposed signs would encroach approximately .66 metres, more or less, into the City's road
allowances and are located approximately 3 metres off the ground.

CONCLUSION:
The appropriate staff has reviewed this request and supports the legalization of the proposed
projecting signs into the Duke St. W. and Breithaupt St. road allowances.
