That the applicant fully satisfies Heritage Kitchener's resolution of September 2, 2003 which requests that the Grand River Conservation Authority conduct an historic review, and documentation of this property, a copy to be provided to the City of Kitchener, and that if 14 Mill Park Drive proves to be of historic significance, as determined by the City's Heritage Planner and Director of Planning, the property is to be plaqued or appropriately recognized. BACKGROUND: The subject property is located on the east side of Mill Park Drive between Huron Road and Green Valley Drive. The land is zoned Hazard Land Zone (P-3) under By-law 85-1 which does not permit dwelling units. One legal non-conforming single detached dwelling is located on the property. The overall condition of the structure is poor. The owner is proposing to demolish the dwelling and leave the land vacant in order to be naturalized. REPORT: 1. Notification Preliminary circulation of the demolition control application was undertaken on May 31,2005 to internal agencies only. Three comments were received (copies attached). As well, a letter and copy of this staff report will be circulated to property owners within a 60- metre radius, as a courtesy, to inform them of the proposed future demolition. The circulation will be undertaken one week prior to the DTS meeting of June 27th, 2005. 2. Planning Comments Under the Planning Act, the purpose of Demolition Control is to maintain residential properties within the municipality and to prevent their premature or unjustified removal. Where no new buildings are proposed, the municipality must determine whether or not the removal of the building is in the public interest. In order to assess whether or not the demolition is in the public interest, the proposal must be weighed against the seven criteria outlined in Council Policy 1- 1010: 1. Property Subject to the Ontario Heritage Act This building is not subject to the Ontario Heritage Act. 2. Architectural and Historical Value of the Dwelling The City's Heritage Planner has noted that the property has been the subject of discussion at Heritage Kitchener and on September 2,2003 the Committee passed a resolution requesting an historic review and documentation of the property. To date this material has not been provided to the City. As such, the City's Heritage Planner is requesting that approval of demolition only be given conditional on the requested documentation being provided (comments attached). 3. Condition of the Dwelling In June 2005 a City Building/Plumbing Inspector examined the subject building. He states that the structure is a "two-storey building with no significant architectural detail. The building was found to be in general disrepair and would require major renovation work both inside and out. would be less expensive to demolish the structure and re-build." (comments attached). 4. Neighbourhood and Streetscape Quality The subject property is located on the east side of Mill Park Dr which is zoned Hazard Land (P-3) and backs onto the Grand River. The single family dwelling located on the lot is a legal non-conforming use. Demolishing the structure, which is in poor condition, and leaving the land vacant and naturalized would be more in keeping with the current zoning and the open space use on this side of the street. Across the street on Mill Park is located Doon Heritage Crossroads and cluster townhouse development. The quality of the neighbourhood or streetscape is not affected by this proposed demolition. 5. Timeframe of Redevelopment No redevelopment is being proposed. The land is to be left vacant and naturalized. 6. Community Feedback Notice of the demolition control application was not circulated to the neighbourhood. 7. Zoning Compliance of the Proposed Use The proposed use as open space is in compliance with the Hazard Land (P-3) zone. 3. Comments Received (copies of comments attached) Copies of comments from the City's Heritage Planner, the Engineering division, and a City of Kitchener Building inspector are attached. 4. Summary Planning staff are satisfied that the proposed demolition satisfies the criteria established in Council Policy 1-1010. As such, Planning Staff recommend that the demolition control application be aooroved subject to the recommended condition. FINANCIAL IMPLICATIONS: None.
