Subject: 44 GAUKEL STREET-SITE REMEDIATION, CITY OF
KITCHENER-NOISE BY-LAW EXEMPTION
RECOMMENDATION:
That the City of Kitchener and its contractor(s~ be exempt from the provisions of Chapter
450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work during the
site remediation of 44 Gaukel Street, City of Kitchener. The request for the noise by-law
exemption is between the hours of 7:00 p.m. to 7:00 a.m. for the period from February 19,
2007 to June 30, 2007.
BACKGROUND:
Under the City of Kitchener Contract No. 06-073 the limits of construction for this site
remediation project include: the 44 Gaukel Street site only bounded by Joseph Street, Charles
Street and Gaukel Street.
REPORT:
The limits of construction for this request for a noise exemption are on 44 Gaukel Street only.
This project is scheduled to begin on February 19, 2007 and is scheduled to continue to
approximately June 30, 2007.
The transportation route for this project will be entering 44 Gaukel Street from Joseph Street via
Victoria Street and exiting Charles Street to Victoria Street.
The request for the noise exemption stems primarily for the removal of coal tar and materials on
the job site. Working during the evening hours and mostly on weekends will help to expedite
the removal operation and minimize the time where it is expected that the odour issues will be at
their worst, thus lessoning the impact on adjacent Region of Waterloo -Grand River Transit
Terminal and CDI properties. Typical construction noise will be generated after the specified
by-law hours due to the timeframe (winter months) required to perform this work.
The request for a noise exemption will permit the contractor(s) to complete their work in a safe
and efficient manner under the limit set out in the contract. Additional dates may be required
under this contract and this exemption will address any unforeseen issues. In order to limit the
impact on the nearby residential areas, the contractor will be required to comply with
requirements for equipment maintenance and operation, in that the contractor is obligated to
maintain all equipment in proper working order including proper noise reduction.
Notification of any overnight or weekend works will be distributed in advance of the
commencement of the work by the contractor.
FINANCIAL IMPLICATIONS:
None.
CONCLUSION:
In order to expedite the construction, reduce adjacent property issues and allow extended hours
of work to take place for this project, we recommend that this request for a noise by-law
exemption be granted.
