Section 1 Section 1 of the Joint Accessibility Plan addresses the accessibility initiatives and actions undertaken in 2006 to address barriers to persons with disabilities in identified municipal by-laws, policies, practices and services. The initiatives presented in the 2007 Joint Accessibility Plan will be identified under the headings of "barrier type" as defined in the Ontarians with Disabilities Act (ODA, 2001) and the Accessibility for Ontarians with Disabilities Act (AODA, 2005). These barrier types are: · Information/Communication · Technological · Policy/Practice · Attitudinal · Physical/Architectural Section 2 Section 2 will present in summary form each municipality's initiatives, actions, department responsible and targeted completion date for the accessibility initiatives to be undertaken in 2007. Where it is possible municipalities participating in the Joint Accessibility Plan will work together on the 2007 initiatives, however, it is the intent that each municipality will individually address each initiative and associated actions outlined in the Section 2 summary for their municipality. Each municipality will continue to seek advice and input from the Grand River Accessibility Advisory Committee (GRAAC) as needed for initiatives in 2007. \Inclusion\Joint Accessibility Plan 2007 3 I 2007 JOINT ACCESSIBILITY PLAN INTRODUCTION This is the 2007 Joint Accessibility Plan prepared by the Joint Corporate Accessibility Steering Group (see page 6) of: · The Corporation of the City of Kitchener · The Corporation of the City of Waterloo · The Corporation of the Township of Woolwich · The Corporation of the Township of Wellesley · The Corporation of the Township of North Dumfries The Joint Accessibility Plan of the above municipalities describes the achievements the Municipalities have taken in the past and the areas to be reviewed, including measures and actions, in the coming year (2007). The municipalities are proud to present the Joint Accessibility Plan and report the steps that staff in cooperation with persons with disabilities, are taking to identify, remove and prevent barriers encountered by persons with disabilities residing in our communities. 2.0 Background The Ontarians with Disabilities Act, 2001 (ODA) was passed into law by the Ontario Legislature on December 4, 2001. The purpose of the Act is "to improve opportunities for persons with disabilities and to provide for their involvement in the identification, removal and prevention of barriers to their full participation in the life of the Province". The ODA applies to all municipalities, hospitals, district school boards, colleges, universities, public transportation organizations, the Ontario Government, ministries and agencies. The ODA, 2001 is available at http://www.gov.on.ca/citizenship/accessibility/english/act2001.htm On September 30, 2002 proclamation brought into law additional sections of the Act including the following municipal obligations: Accessibility Advisory Committee · Municipalities of 10,000 or more must establish an Accessibility Advisory Committee and the majority of members must be persons with disabilities. · Each year the committee shall advise Council about the preparation, implementation and effectiveness of its accessibility plan. · Council will seek advice from the committee on the accessibility for persons with disabilities to buildings, structure or premises that Council purchases, builds or significantly renovates; leases for its own use or those buildings designated as a municipal capital facility. · The functions of the committee include reviewing site plans and drawings for new buildings or developments (Section 41 of the Planning Act) that the committee selects. \Inclusion\Joint Accessibility Plan 2007 4 I 2007 JOINT ACCESSIBILITY PLAN Accessibility Plan · Each year the Council of every municipality shall prepare an Accessibility Plan, and get advice from its Accessibility Advisory Committee. · The Accessibility Plan, which must be made available to the public, shall address the identification, removal and prevention of barriers to persons with disabilities in the municipality's by-laws, policies, practices and services. · Municipalities must prepare and publish an Accessibility Plan that follows the Ontarians with Disabilities Act requirements annually. Joint Accessibility Committees/Joint Accessibility Plans While the legislation states that each municipality must have an Accessibility Advisory Committee (population of 10,000 and more) and an annual Accessibility Plan, the Act allows for two or more municipalities to implement a Joint Accessibility Advisory Committee and to prepare a Joint Accessibility Plan (Sec 17 ODA). Building upon a strong foundation of accessibility initiatives and a longstanding commitment to working in collaboration with persons with disabilities in Kitchener - Waterloo and area, the 2007 plan reflects joint accessibility planning between the municipalities in order to: · provide for a more seamless approach to the removal of barriers encountered by persons with disabilities in our community. · maximize the use of existing local expertise and resources. · broaden the collaborative process through sharing of staff training and education opportu n ities. · integrate accessibility planning into strategic and business planning practices of the municipalities. Bill 118 - Accessibility for Ontarians with Disabilities Act (AODA 2005) The AODA 2005 received Royal Assent in the Ontario Legislature in June 2005. The focus of the AODA 2005 will be on improving accessibility in areas such as building and spaces, employment, customer service, communications and transportation in the private, government and broader public sector. The AODA 2005 will repeal the ODA 2001 and intends to: · achieve an accessible Ontario on or before January 1, 2025 · establish and implement mandatory and enforceable accessibility standards to be achieved within five years or less · maintain the requirement of a Legislated Municipal Accessibility Advisory Committee (GRAAC) \Inclusion\Joint Accessibility Plan 2007 5 I 2007 JOINT ACCESSIBILITY PLAN Compliance with accessibility standards will not be optional and organizations covered by the Act will be required to demonstrate their compliance by filing accessibility reports and making them public. The province is currently establishing Accessibility Standards Development Committees however, it is expected that any mandatory accessibility standards may not be legislated until 2007. Clements, Hawkesville, Heidelberg, Kingwood and Bamberg. ***The Township of North Dumfries consists of a variety of small towns and villages including Ayr, Roseville, Branchton and Clyde. 5.0 Grand River Accessibility Advisory Committee Activities in 2006 In 2003, the municipalities of the Regional Municipality of Waterloo, the City of Kitchener, the City of Waterloo and the Townships of Woolwich, North Dumfries and Wellesley adopted the Grand River Accessibility Advisory Committee (GRAAC) as the Joint Accessibility Advisory Committee to comply with the ODA, 2001. Actions Undertaken in 2006 · City of Kitchener reviewed snow clearance policies and practices and identified some target areas for snow clearance. · Township of Woolwich continues to respond to input from persons with disabilities on areas where the Township could improve its snow clearing service on sidewalks and in municipal parking lots. \Inclusion\Joint Accessibility Plan 2007 15 I 2007 JOINT ACCESSIBILITY PLAN · Cities of Kitchener and Waterloo jointly advertise snow clearing ads in the Record. Costs are shared and the ads include by-law standards for both cities as well as phone numbers to call if you are elderly or unable to clear your sidewalk or if you'd like to report a resident who has not cleared their sidewalk. Canada Post also distributes a flyer that we have developed to help educate residents that is delivered to each resident in Kitchener and Waterloo. · Waterloo continues to proactively enforce the snow clearing requirements of our by- law through hiring Snow Inspectors. These Inspectors patrol chronic areas of the city where residents/property owners continually (annually) fail to abide by the requirements of our by-law. One notice is issued that requires property owners to clear their sidewalk within 24 hours. After that time expires, a City Crew attend and clear the sidewalk down to the bare pavement. The property owner is invoiced for the equipment and labour required clearing their sidewalk. Unpaid invoices are added to the municipal taxes for that property. · City of Waterloo continues to implement recommendations of winter maintenance report as approved by Council in 2005. City of Waterloo sidewalk snow clearing priorities are as follows: · Sidewalks in front of City property, · Access sidewalks to City property and for operator/equipment safety · Highway over pass sidewalks · Sidewalks adjacent back-lotted properties · Block to Block walkway links · Current chargeable sidewalks · Park pathways that are school routes only · City of Waterloo will continue the test pilot for curb faced sidewalk snow clearing. Actions Undertaken in 2006 · City of Kitchener reviewed and made changes to the Urban Design Manual so as to ensure consistency with the Ontario Traffic Manual. · City of Kitchener inventoried accessible parking spaces in municipal lots that are attached to buildings. · The Township of Woolwich incorporated accessible parking space standards from the City of Kitchener Barrier-Free Design Standards into its Zoning By-law which was approved in November, 2006. · Property owners in the City of Waterloo designate an individual to enforce their parking rules and regulations on private property (Private Enforcement Officers), if the property includes disabled parking spaces, a By-law Officer attends the property to ensure that there is sufficient signage for these parking spaces. Once the individual has been appointed as a Private Enforcement Officer, they are trained on the proper issuance of a parking ticket. The property address is added to the schedule of the Disabled Parking By-law #91-9 which allows both the Private · Enforcement Officer and a City of Waterloo By-law Officer to ticket illegally parked vehicles. · The City of Waterloo provides proactive enforcement at local shopping malls and apartment complexes by Private Enforcement Officers and City of Waterloo By-law Enforcement Officers ensures that these parking spaces are being used by those individuals who possess a valid permit. This is done on a daily basis. · The new Willis Way extension in the City of Waterloo includes 3 on-street accessible parking stalls mid-block between King and Caroline. These are adjacent to one of the main Waterloo Town Square mall entrances and retained 2 accessible parking stalls in the Waterloo Town Square East Lot in close proximity to Scotiabank, which has a high number of seniors as clients. This lot is the subject of the Public Square. \Inclusion\Joint Accessibility Plan 2007 17 I 2007 JOINT ACCESSIBILITY PLAN · The City of Waterloo installed a total of 6 accessible parking stalls in the new Waterloo Town Square South Lot in 2 groups of 3 stalls. They were specifically separated from the originally planned single group of 6 accessible parking stalls in order to locate them closer to a wider variety of high-demand destinations such as First United Church. The Church has a high number of senior's attendees who use that lot and there is a walkway to the Church property close to the spaces. · The City of Waterloo also installed fully accessible walkways throughout the lot with curbed pedestrian safety islands adjacent to each row of spaces so that elderly or disabled people or parents with young children in strollers would have a safe place to stop away from moving vehicles and next to trees which will eventually grow to provide a shade canopy over the walkway.
