Proulx, Director of Facilities Management Wards} Involved: Ward 6 Date of Report: February 20, 2007 Report No.: CRPS: 07-031 Subject: UTILITY EASEMENT REQUIREMENT AT 189 JOSEPH STREET RECOMMENDATION: That Legal Services be directed to acquire a 2 metre easement adjacent to the road allowance along the frontage of 189 Joseph Street, between Linden Avenue and Victoria Street from Ball Brothers Limited for a purchase price not to exceed $2,000, plus costs of the reference plan and all incidental costs associated with the transaction; and further, That the Mayor and Clerk be authorized to execute the necessary documentation to effect the transfer of easement. BACKGROUND: We were approached by Utilities Division to obtain an easement adjacent to the road allowance along the frontage of 189 Joseph Street for the purpose of installing a gas line. (Map attached). The road profile is filled with intersecting pipes and wires. There was no clear path for the installation of the gas line; therefore, an easement purchase is required. REPORT: Staff approached the property owner to negotiate a price and to get consent to proceed with the work. The property owner has agreed to allow the City of Kitchener to install the gas line along the front of its property. Reference plan details are underway. FINANCIAL IMPLICATIONS: Purchase costs, reference plan expenses, registration of easement costs and all incidental costs associated with this transaction are to be paid by the City of Kitchener out of existing budgets. -2- COMMUNICATIONS: N/A CONCLUSION: Staff recommends that the City acquires the easement fronting 189 Joseph Street in order to provide gas utility to the affected area.
