The Development and Technical Services Committee met this date, commencing at 6:45 p.m.

1. DTS-07-019 - REVISIONS TO MUNICIPAL CODE, CHAPTER 6$3
- DELEGATION OF AUTHORITY FOR SITE PLAN
The Committee considered Development and Technical Services Department report DTS-07-
019, dated January 19, 2007, regarding revisions to Chapter 683 of the City of Kitchener
Municipal Code (Delegation of Authority for Site Plan).
On motion by Councillor G. Lorentz -
it was resolved:
"That Chapter 683 (Site Plan Control) of the City of Kitchener Municipal Code, be
amended in the form of the draft by-law attached to Development and Technical Services
Department report DTS-07-019, to implement the following:
(a) that either the Supervisor of Site Plan Development or the Manger of Development
Review be appointed as the delegated approval authority for Site Plan Approval
pursuant to Section 41 of the Planning Act, with either the Director of Planning or
the Manager of Long Range and Policy Planning as the alternates; and,
(b) that the term "development" be as defined in Section 41(1) of the Planning Act;
and,
(c) that owners of lands that are subject to site plan control must obtain site plan
approval prior to undertaking development on their lands; and further,
(d) to create an offence for failure to obtain site plan approval prior to undertaking
development on lands subject to site plan control in the City of Kitchener, in
accordance with Section 67 of the Planning Act."
2. DTS-07-021 - CONSTRUCTION ZONE SIGNS -SPEED FINE SIGNS
The Committee considered Development and Technical Services Department report DTS-07-
021,dated January 23, 2007, regarding construction zone signs -speed fine signs.
On motion by Councillor G. Lorentz -
it was resolved:
"That the Director of Transportation Planning, or designate, be given the authority to
designate a "Construction Zone" as well as to set the temporary speed limit within that
construction zone; and further,
That the Director of Transportation Planning, or designate, ensure that records are kept
detailing when a construction zone speed is changed."

3. DTS-07-026 - AMENDMENT TO BY-LAW 2005-170
- DELEGATION OF AUTHORITY FOR DRAFT PLAN OF SUBDIVISION AND
DRAFT PLAN OF CONDOMINIUM APPROVALS
The Committee considered Development and Technical Services Department report DTS-07-
026, dated February 8, 2007, regarding an amendment to By-law 2005-170 -Delegation of
Authority for Draft Plan of Subdivision and Draft Plan of Condominium Approvals.
On motion by Councillor G. Lorentz -
it was resolved:
"That By-law 2005-170 be amended as outlined in the proposed by-law attached to
Development and Technical Services Department report DTS-07-026, dated February 8,
2007, for the purpose of appointing the Manager of Long Range and Policy Planning as
one of two alternates authorized to exercise all of the subdivision and condominium
approval authority delegated to the Manager of Development Review in his/her absence,
and to change the title of Manager of Design and Development to the Manager of
Development Review."
4. DTS-07-027 - TRAFFIC CALMING -ADDRESSING ALL LOCATIONS
The Committee considered Development and Technical Services Department report DTS-07-
027, dated February 12, 2007, regarding traffic calming and the impacts of conducting additional
reviews.
Mr. McBride reviewed the staff report and noted that the recommended contract position would
cost approximately $80,000 per year, including fringe benefits and office space. He noted that,
in addition to the cost of another staff positions, there would be increased capital costs for the
actual road works.
Councillor Vrbanovic questioned whether traffic calming reviews can be done in a different
fashion now that the Environmental Assessment Act does not govern traffic calming measures.
Mr. McBride responded that the only difference is that we no longer have to notify the Ministry of
the Environment or give them the final results. Extensive public consultation is still necessary
and traffic calming still must be done to sound engineering practices. Further, he advised that all
other municipalities he surveyed are still doing a full analysis and public consultation.
Upon questioning, Mr. McBride advised that, in addition to the recommended position, existing
staff would still be able to undertake the 4 locations per year that they are currently undertaking.
Mayor Zehr questioned the statement on page 4 of the report concerning the limitations of
contracting out the count program. Mr. McBride advised that there would be no opportunity to
respond in a timely manner to requests received to address specific time-urgent requests.
Mayor Zehr then commented that this additional spending on staff and the resulting additional
capital costs should be reviewed by the Corporate Management Team, or in fact, should be
added into the current budget process. Although he thought that this recommendation was
reasonable, the Mayor suggested a motion that this proposal be included in the current budget
process.
On motion by Mayor C. Zehr -
it was resolved:
"That the following recommendation from Development and Technical Services
Department report DTS-07-027, dated February 8, 2007, be referred to the budget
process:
"That, should Council wish to increase the number of traffic calming reviews to be
completed each year, a temporary three (3) year contract position be hired to execute
outstanding traffic calming review locations."

5. DTS-07-024 - EMERGENCY REPAIRS, LOWER LAUREL CREEK WATERCOURSE
The Committee considered Development and Technical Services Department report DTS-07-
024, dated January 29, 2007, regarding emergency repairs on the Lower Laurel Creek
Watercourse.
Mr. D. Mansell advised that the Region is a property owner in this area, and they may share the
costs of this work. He advised that he will report to Council in March on the results of
negotiations with the Region or on the tender.
On motion by Councillor J. Smola -
it was resolved:
"That Engineering Services tender the emergency repairs on the Lower Laurel Creek
watercourse with said tender and total costs to be brought to Council for final approval."
6. DTS-07-022 - ZONE CHANGE APPLICATION ZC 06I31IDIJB

Mayor C. Zehr declared a pecuniary interest in this matter as he owns land in close proximity to
the subject property, and he did not participate in any discussion or voting on this matter.
The Committee considered Development and Technical Services Department report DTS-07-
022, dated February 8, 2007, regarding Zone Change Application ZC 06/31/D/JB to change the
zoning of the lands on Deer Ridge Drive.
Mr. J. Willmer introduced the report and advised that some minor changes have been made to
the draft by-law attached to the report. Copies of a revised draft by-law, dated February 19,
2007, noting these changes, were distributed to the Committee members this date. He advised
that these changes are acceptable to the applicant.
Mr. P. Chauvin, MHBC Planning, was in attendance on behalf of the applicant, in support of the
staff recommendation. He advised that the applicant is in support of the revised by-law
distributed this date.
On motion by Councillor B. Vrbanovic -
it was resolved:
"That Zone Change Application ZC 06/31/D/JB (JS Properties, Deer Ridge Drive) for the
purpose of changing the zoning from Residential Three (R-3) with special provisions
243R, 260R and 2350 to Residential Three (R-3) with special provisions 243R, 260R,
456R and 2350, be approved, in the form shown in the "Proposed By-law", dated
February 19, 2007, distributed at the Development and Technical Services Committee
meeting of February 19, 2007."
7. OPERATION AND INVENTORY OF PARKS & OPEN SPACES GARBAGE CONTAINERS
Mayor Zehr noted that he was not able to attend the Community Services Committee meeting
earlier this date, where this matter had been discussed. He requested that staff investigate the
possibility of locating recycle bins in our parks and open spaces as well as garbage containers.
