Subject: SUMMARY WATER REPORT - JANUARY 1 ST TO
DECEMBER 31ST, 2006
RECOMMENDATION:
That the 2006 the City of Kitchener Summary Drinking Water Report be accepted by Council as
required by O. Reg 170/03 Schedule 22 of the Safe Drinking Water Act.
And that, the City of Kitchener provide a copy of the Summary Drinking Water report to the
Township of Woolwich as required by Schedule 22 of O.Reg. 170/03

As outlined in Schedule 22 of the Drinking Water Systems Regulation (O.Reg.170/03) of the
Safe Drinking Water Act, 2002, a summary report is to be prepared and given to the members
of the municipal council. The following information is required to be included in this report:
" (a) list the requirements of the Act., the regulations, the system's approval and any order that
the system failed to meet at any time during the period covered by the report and specify the
duration of the failures; and
(b) for each failure referred to in (a), describe the measures that were taken to correct the
failure. yy
The report must also include:
"1. A summary of the quantities and flow rates of the water supplied during the period covered
by the report. . - - yy

The MOE conducted an inspection of the Kitchener Distribution System on July 11, 2006.
During the inspection, it was found that Kitchener was in non-compliance since the number of
microbiological samples taken did not meet the sampling requirements in Section 10-2 of Reg.
170/03. The non-compliance was unexpected since Kitchener and the other area Municipalities
were under the understanding that the 1998 agreement and subsequent 2003 re-affirmation
from the MOE stating that the "RMOW's water supply is also considered one large distribution
system. Therefore, the combined water distribution sampling must meet the combined total
population sampling requirements set out in Schedule 2, O.Reg. 459..." was still valid. The
MOE had never expressed a concern before through subsequent annual inspections in 2003,
2004 and 2005.
The MOE's interpretation of O.Reg. 170/03, which was released in May 2003, was that the new
regulation was more extensive than O.Reg. 459. It should be noted that the number of
microbiological samples required did not change in the new regulation.
Corrective Actions: At the time of the non-compliance, the City of Kitchener tested between 68
to 80 samples for any given calendar month at several sites across the City. To become
compliant the frequency of sampling will be increased to 123 samples per month by March 31,
2007.
A summary of the quantities of the water supplied by the Regional Municipality of Waterloo
during the period covered by the report is noted on the attached Table 1.0.
FINANCIAL IMPLICATIONS:
Increased sampling requirements will increase the sampling costs: based on 68-80 monthly
samples, anticipated 2007 annual laboratory fees range from approximately $19,000. With 123
monthly samples, the annual costs will increase to approximately $32,000 which is inside the
2007 budget allotment for watermain operating expenses.
The MOE and the Regional Municipality of Waterloo's Community Department of Health have
been informed of any adverse conditions within the system, and we continue to work to provide
safe drinking water for the residents of Kitchener.
Under Schedule 22 of O.Reg. 170/03, the City of Kitchener is required to provide a copy of their
Summary Report to each Municipality to which it supplies water, namely the Township of
Woolwich.
