HomeMy WebLinkAboutAdjustment - 2002-10-01 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD OCTOBER 1, 2002 MEMBERS PRESENT: Messrs. P. Kruse, P. Britton and B. Isaac. OFFICIALS PRESENT: Mr. B. Sloan, Planner and Ms. J. Billett, Secretary-Treasurer. Mr. P. Kruse, Vice-Chair, called this meeting to order at 10:00 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, October 21, 2002, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS Submission No.: Applicant: Property Location: Legal Description: SG 2002-014 Regional Municipality of Waterloo 73 Queen Street North Part Lot 1, Registered Plan 401 Appearances: In Support: Mr. Brian Bechtel Contra: None Public Submissions: None The Committee was advised that the lands involved in this application contain an existing Provincial Court House. The applicant is requesting permission to locate one 2 sided and one single sided non-illuminated ground signs on the City's road right-of-way adjacent to Queen Street North rather than setback the required 3 m (9.84 ft.) from the lot line of the subject property. The applicant will also require Council approval of an encroachment agreement to permit the signs to be located as proposed. The Committee was in receipt of the following City staff / agency comments and public submissions (if any): Planning Division - September 23, 2002 - in support, subject to an encroachment agreement with the City and generally in accordance with the revised site plan dated September 23, 2002; The following had no concerns or comments with respect to this application: · Director of Building - September 23, 2002 · Traffic & Parking Analyst - September 25, 2002 · Region of Waterloo - September 25, 2002 · Grand River Conservation Authority - September 24, 2002. Mr. Brian Bechtel, Region of Waterloo, advised that Kitchener City Council at its meeting held on September 30, 2002 approved the entering into of an encroachment agreement with the COMMITTEE OF ADJUSTMENT 27 OCTOBER 1, 2002 Submission No.: SG 2002-014 (Cont'd) Region of Waterloo to permit the signs to be located on the Queen Street North road allowance, subject to obtaining minor variance approval. Moved by Mr. P. Britton Seconded by Mr. B. Isaac That the application of the Regional Municipality of Waterloo requesting permission to locate two non-accessory (third party), non-illuminated ground signs on the City's Queen Street North road allowance, adjacent to Part Lot 1, Registered Plan 401, 73 Queen Street North, Kitchener, Ontario, BE APPROVED, subject to the following conditions: 1. That subject to the satisfaction of the City's Solicitor, the Regional Municipality of Waterloo shall enter into an encroachment agreement with the Corporation of the City of Kitchener to permit two ground signs to be located on the Queen Street North road allowance. 2. That the variance as approved in this application shall be in accordance with the revised site plan dated September 23, 2002. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
