HomeMy WebLinkAboutCRPS-07-059 - Exemption to Chapter 450 (Noise) - The StillREPORT Report To: Finance and Corporate Services Committee Date of Meeting: May 7, 2007 Submitted By: Troy Speck, General Manager of Corporate Services Prepared By: Shayne Turner, Director of By-law Enforcement Ward(s~ Involved: Wards 1 and 6 Date of Report: May 1, 2007 Report No.: CRPS-07-059 Subject: EXEMPTION TO CHAPTER 450 (NOISE) -THE STILL, 125 KING STREET WEST RECOMMENDATION: That an exemption to Chapter 450 (Noise} of the City of Kitchener Municipal Code be granted to The Still Bar and Grill at 125 King Street West, for every Wednesday evening between May 9 and October 3, 2007, between the hours of 7:30 P.M. and 11 P.M., for their Blues Jam events; and further, That an exemption to Chapter 450 (Noise} of the City of Kitchener Municipal Code be granted to The Still Bar and Grill at 125 King Street West, for every Saturday afternoon between May 12 and September 1, 2007, between the hours of 12 Noon and 5 P.M., for a series of open court yard concerts. BACKGROUND: As part of their summer entertainment program, The Still is planning to hold their regular Blues Jam night, each Wednesday evening between 7:30 P.M. and 11 P.M. between May and October. The music will be played on the patio area. As such, there is the potential for staff to receive complaints with respect to the loud music. In addition, The Still is proposing to offer Saturday afternoon entertainment, in their courtyard area, in conjunction with other downtown businesses. REPORT: This series of entertainment events are aimed at attracting business to the downtown area during evenings and weekends. The Blues Jam evenings were held in 2006, in the much the same manner as is planned this year. The By-law Enforcement Division did receive some complaints last year and worked with The Still staff to resolve the concerns. This year, staff at The Still have indicated their willingness to attempt to control the music and will work with the By-law Enforcement staff in the event that similar concerns are raised. It is recognized that events in the downtown area often involve music, and the resulting potential for complaints to be registered. Staff will work with businesses and event organizers to ensure that the event is conducted in a reasonable manner. FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this event, the By-law Enforcement Division does not object to this requestfor an exemption.
