HomeMy WebLinkAboutAdjustment - 2003-12-09 SG '-' ~ ~ COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD DECEMBER 9. 2003 MEMBERS PRESENT: Ms. D. Angel, Messrs. P. Britton, B. Isaac and Z. Janecki . OFFICIALS PRESENT: Mr. B. Sloan, Planner and Ms. D. Gilchrist, Acting Secretary-Treasurer. Mr. P. Britton, Chair, called this meeting to order at 10:50 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, December 15, 2003, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: Applicant: Property location: legal Description: SG 2003-014 Jamesway Construction Co. 685 Fischer-Hallman Road Part Lot 47. German Companv Tract Appearances: In Support: Mr. F. Tarades Contra: None Public Submissions: None The Committee was advised that the applicant requests permission to permit a pylon sign with automatic changing copy, to be located approximately 25 m (82.02 ft.) from a Residential Zone rather than the required 150 m (492.13 ft.). The Committee noted the comments of the Region of Waterloo, Transportation Planner, dated December 2, 2003, advising they have no concerns with this application. The Committee noted the comments of the Development & Technical Services Department, dated November 28, 2003, recommending approval of the application. Mr. Sloan advised the Committee that although the variance seemed to be significant, the impact of the variance is not great. He noted that the sign does not directly face the residential properties, and the residences on the other side of Fischer-Hallman Road are setback quite a distance from the street. Also, the portion of the sign containing automatic changing copy is a relatively small. He requested that should the Committee approve this application, it specify in the decision the size of the portion of the sign which may contain automatic changing copy. Angel That the application of Jamesway Construction Co. requesting permission to erect a pylon sign having a 1.49 m2 (16.04 sq. ft.) area containing automatic changing copy, with a sign to be located approximately 25 m (82.02 ft.) from a Residential Zone rather than the required 150 m (492.13 ft.), on Part Lot 47, German Company Tract, 685 Fischer-Hallman Road, Kitchener, Ontario, BE APPROVED subject to the following condition: 1. That the automatic changing copy portion of the subject pylon sign shall not exceed an area of 1.49 m2 (16.04 sq. ft.). It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Carried 2. Submission No.: Applicant: Property Location: Leaal Descriotion: SG 2003-015 Suncor Energy Products Inc. 3011 King Street East Lot 10. Part Lot 30, Reqistered Plan 959 Appearances: In Support: Mr. A. Lebon Contra: None Public Submissions: None The Committee was advised that the applicant requests permission to erect 2 fascia signs having a clearance of 1.27 m (4.17 ft.) between the bottom of the signs and grade rather than the required 2.44 m (8 ft.). The Committee noted the comments of the Region of Waterloo Transportation Planner, dated December 2,2003, advising they have no concerns with this application. The Committee noted the comments of the Development & Technical Services Department, dated November 26, 2003, in support of this application. Moved by Mr. B. Isaac Seconded by Mr. Z. Janecki That the application of Suncor Energy Products Inc. requesting permission to erect 2 fascia signs on the kiosk building having a clearance between the bottom of the sign and grade of 1.27 m (4.17 ft.) rather than the required 2.44 m (8 ft.), on Part Lot 10, Plan 959, and Part Lot 30, Plan 986, 3011 King Street East, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. Jenkins Contra: None Public Submissions: None The Committee was advised that the applicant requests legalization of a pylon sign having a clearance between the bottom of the sign and grade of 1.27 m (4.17 ft.) rather than the required 2.44 m (8 ft.). The Committee noted the comments of the Region of Waterloo Transportation Planner, dated December 2, 2003, in which they advised that they have no concerns with this application. Janecki That the application of Frederick Mall Corporation requesting legalization of a pylon sign having a clearance of 1.27 m (41.7 ft.) between the bottom of the sign and grade rather than the required 2.44 m (8 ft.), on Part Lot X, Plan 414, and Part Lot 9, Subdivision of Lot 3, German Company Tract, 385 Frederick Street, Kitchener, Ontario, BE APPROVED. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
