Cybalski and B. Isaac. OFFICIALS PRESENT: Ms. 1. Malone-Wright, Senior Planner, Mr. R. Parent, Traffic & Parking Analyst, Ms. R. Brent, Assistant Secretary-Treasurer, and Ms. D. Gilchrist, Secretary-Treasurer Mr. P. Britton, Chair, called this meeting to order at 9:38 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Sign) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to fence variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, October 3, 2005, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. UNFINISHED BUSINESS 1. Submission No.: Applicant: Property Location: Leqal Description: SG 2005-007 Brick by Brick Developments Ltd. 192 Activa Avenue Block 15. Reqistered Plan 58M-209 Appearances: In Support: Mr. S. Voisin Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to erect a pylon sign with a minimum clearance between the bottom of the sign and grade of 2 m (6.56 ft.) rather than the required 2.44 m (8 ft.). The Committee considered the report of the Development and Technical Services Department, dated August 9, 2005, advising they have no concerns with this application. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated August 2, 2005, advising they have no concerns with this application. Moved by Mr. D. Cybalski Seconded by Mr. B. Isaac That the application of Brick by Brick Developments Ltd. requesting permission to erect a pylon sign with a minimum clearance between the bottom of the sign and grade of 2 m (6.56 ft.) rather than the required 2.44 m (8 ft.), on Block 15, Registered Plan 58M-209, 192 Activa Avenue, Kitchener, Ontario, BE APPROVED. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Carried This meeting recessed at 9:43 a.m., to allow the Committee to consider Applications for Minor Variance to the City's Fence By-law, and reconvened at 11 :00 a.m. with the following members present: Messrs P. Britton, D. Cybalski & B. Isaac. NEW BUSINESS 1. Submission No.: Applicant: Property Location: LeQal Description: SG 2005-010 Grand River Credit Union 1334 Weber Street East Lot 30. Part Lot 31. Plan 687 Appearances: In Support: Mr. J. Hennebry Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to erect a pylon sign containing automatic changing copy in the same location as the existing pylon sign, located 28 m. (91.86') from a residential zone rather than the required 150 m. (492.12'). The Committee considered the report of the Development and Technical Services Department, dated September 6,2005, in which they advised they have no objections to this application. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated September 7, 2005, in which they advise that the sign will be located within the Weber Street road allowance, and the owner will be required to enter into an encroachment agreement satisfactory to the Region of Waterloo for the sign. This will require the owner to provide and deposit at its expense a Survey Reference Plan to delineate the extent of the encroachment. Mr. Hennebry advised the new sign will be located in exactly the same position as the existing sign, and will be slightly shorter. Moved by Mr. Z. Janecki Seconded by Mr. B. Isaac That the application of Grand River Credit Union requesting permission to erect a pylon sign containing automatic changing copy in the same location as the existing pylon sign, located 28 m (91.86') from a residential zone rather than the required 150 m (492.12') on Lot 30, Part Lot 31, Plan 687, 1334 Weber Street East, Kitchener, Ontario, BE APPROVED, subject to condition: 1. That the owner shall enter into an encroachment agreement satisfactory to the Region of Waterloo for the sign; which includes the requirement that the owner provide and deposit at their expense a Survey Reference Plan to delineate the extent of the encroachment. Elbaz Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to replace an existing pylon sign with a pylon sign having a height of 8.2 m. (26.9') rather than the permitted 7.5 m. (24.6') and a sign area of 21 sq. m. (226 sq. ft.) rather than the permitted 20 sq. m. (215.28 sq. ft.). The Committee considered the report of the Development and Technical Services Department, dated September 6, 2005, advising they have no concerns with this application. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated August 31,2005, advising they have no concerns with this application. The Committee considered the report of the Kitchener-Wilmot Hydro Inc., dated September 7, 2005, advising of safety standards established by Ontario Regulation 22/04, and the Occupational Health and Safety Act, for the benefit of the applicant. Isaac That the application of First Capital (Fairway) Corporation requesting permission to replace an existing pylon sign with a pylon sign having a height of 8.2 m (26.9') rather than the permitted 7.5 m (24.6') and a sign area of 21 sq. m. (226 sq. ft.) rather than the permitted 20 sq. m. (215.28 sq. ft.), on Part Lot 2, Registered Plan 1525, 655 Fairway Road South, Kitchener, Ontario, BE APPROVED. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
