EXECUTIVE SUMMARY: Kitchener Soccer Club utilizes approximately 450 sq/ft of City of Kitchener space for the purpose of administrative offices located at Budd Park, 1111 Homer Watson Blvd, Kitchener ON. Staff recommends that the City of Kitchener enter into a License agreement with the Kitchener Soccer Club regarding the use of this space. The License agreement outlines all of the terms, most notably a three year duration and a licensing fee that incorporates an incentive for the club to continue to contribute funds to the improvements of the indoor facility. REPORT: Minor sport organizations that are affiliated with the City of Kitchener, have all applied for and met the criteria for affiliation under the City of Kitchener's Minor Sport Affiliation Policy. Kitchener Soccer Club is an affiliate of the City of Kitchener. The purpose of this License agreement is to formalize the relationship with the soccer club in regards to the use of office space at Budd Park. Historically Kitchener Minor Soccer was responsible for the operation of the entire Budd Park indoor facility including the payment of utilities. Upon the restructuring of the Kitchener Soccer Club the City offered the continued use of office space while city staff took over operations of the remainder of the facility. The license agreement serves to formalize the relationship in existence between both parties at Budd Park. Report No. CSD-07-042 Page 2 Highlights of the agreement are as follows. · City of Kitchener staff located at Budd Park will have access to the Fax and photo copy machines located in the Soccer office. The City of Kitchener will be charged back for use of this equipment on a cost recovery basis. · As of Jan 15t 2008 the Soccer Club will be responsible for a license fee of $150.00 per month. For any funding provided by the Licensee for improvements to the facility outside of the licensed area the licensee will receive a discount in rental fees of $0.50 on the dollar to a maximum of V2 the monthly rental fee. This discount will continue until the improvement funds have been credited to the rental account. · Either party may terminate this agreement with Ninety days notice. · Kitchener Soccer Club will have 24hr access to their office space for the purpose of performing administrative duties related to providing a Soccer program. · The City will provide snow removal for the premises as well as provide parking spaces for 3 Soccer Club staff. · The City of Kitchener will make 4 of the advertising rink boards available to the Soccer club to assist them in generating sponsorships and fundraising. The new lease agreement will contain provisions pertaining to any damage occurring to the location and allow for negotiations on relocating the club to a suitable space. FINANCIAL IMPLICATIONS: The implementation of this License agreement will generate a revenue stream for the office space that can be designated to offset some of the utility fees incurred through the operations of the entire facility. The financial expectation will be to receive $1800.00 in value per year to better the facility or assist with utilities located at Budd Park. CONCLUSION: Staff support this licensing agreement with Kitchener Soccer Club as it will provide structure to the partnership that is in place regarding the use of office space at Budd Park. By creating structure the municipality and KSC can better plan for the future and create expectations of service that support the operations of both parties located at Budd Park.
