HomeMy WebLinkAboutCouncil Minutes - 2002-11-04 SSPECIAL COUNCIL MINUTES NOVEMBER 4, 2002 CITY OF KITCHENER A special meeting of City Council was held at 2:30 p.m. this date, Chaired by Mayor C. Zehr and with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. The purpose of the meeting was to consider 2003 appointments to the Standing and Special Committees of City Council and Boards and to authorize an in-camera meeting of Council. Attached hereto and forming part of these minutes are the appointments as approved for 2003 with the exception of those specifically noted in the minutes. All positions were filled by acclamation unless noted in the minutes. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That pursuant to Council Policy 1-63, Council consider applications received after the deadline date from the following individuals: David Tsarfati, Derek Czajkowski, Sher DiCiccio, Mike Peng, Sally Gunz, Derek Lippert, David Marks, William Ford and Tony Duscio." Carried Unanimously. Council was made aware of the fact that no veterinarian had made application to sit on the Animal Designation Appeal Committee or the Dog Designation Appeal Committee. The Deputy City Clerk recommended deferral of the appointment of a veterinarian to these Committees in order to allow staff time to solicit applications from a suitable candidate. Moved by Councillor C. Weylie Seconded by Councillor B. Vrbanovic "That Councillor J. Smola be appointed to the Animal Designation Appeal Committee and the Dog Designation Appeal Committee and that the Ward 3 Councillor, once elected, be appointed as the alternate representative; and further, That appointment of a veterinarian to the Committees be deferred in order to allow staff time to solicit applications from local veterinarians." Carried. Councillor J. Smola raised a concern regarding the difficulties with the Downtown Advisory Committee obtaining a quorum for many of its meetings and suggested that two representatives of Wards 1 and 6 be appointed to the Committee rather than just one from each Ward. Moved by Councillor J. Smola Seconded by Councillor G. Lorentz "That notwithstanding the provisions of Clause 2 of Council Policy 1-90 (Downtown Advisory Committee Terms of Reference), two representatives be appointed from each of Wards 1 and 6." Carried. Councillor M. Galloway raised a concern regarding the number of new applicants for Heritage Kitchener which may result in significantly changing the dynamics of the Committee and suggested that although they did not make application due to the fact they have reached their 6-year term, that Ms. P. Wagner and Mr. E. Lucy be considered for appointment to this Committee. Councillor Galloway also pointed out that of all the applicants there were none that would be representing the Upper Doon Conservation District which Mr. Lucy has represented in the past. Councillor G. Lorentz suggested that the rule regarding the 6-year term was put in place in order to allow others the opportunity to sit on these Advisory Committees. SPECIAL COUNCIL MINUTES NOVEMBER 4, 2002 - 431 - CITY OF KITCHENER Moved by Councillor C. Weylie Seconded by Councillor M. Galloway "That notwithstanding the provisions of Clause 5 of Council Policy 1-63 (Appointment to Boards and Committees), we hereby confirm the following appointment, namely: Mr. E. Lucy - Heritage Kitchener." Carried with required 2/3 majority. Moved by Councillor B. Vrbanovic Seconded by Councillor M. Galloway "That notwithstanding the provisions of Clause 5 of Council Policy 1-63 (Appointment to Boards and Committees), we hereby confirm the following appointment, namely: Ms. P. Wagner- Heritage Kitchener." Motion Lost. Council then considered the vacancies on the Property Standards Committee and the following individuals were nominated: John Gazzola, Jim Law and Nelson Stead. The approved voting procedure was then utilized which resulted in Messrs. Gazzola and Stead being appointed to the Property Standards Committee. Council was in receipt of a letter from Mr. Jamie Grant, General Manager, Centre in the Square, requesting that Council consider the appointment recommendation of the Board of Director's Personnel Committee. Moved by Councillor B. Vrbanovic Seconded by Councillor M. Galloway "That Ms. Joan Euler and Mr. Rodney Goetz be appointed for a 3-year term to the Board of Directors of the Centre in the Square." Carried. Council was in receipt of a letter from Mr. Ron Charie, President and CEO, Kitchener Power Corporation, requesting that Council consider the appointment recommendation of the Board of Director's Nominating Committee. Mayor C. Zehr also advised that in accordance to Council Policy I- 115 (Appointments - Board of Directors - Kitchener Power Corporation for the 2003 term a Councillor shall be appointed to the Board. Moved by Councillor B. Vrbanovic Seconded by Councillor M. Galloway "That Ms. Betty Sims, Ms. Sandi Ellis and Mr. Bruce Lee be appointed for a one-year term to the Board of Directors of the Kitchener Power Corporation; and further, That Councillor J. Smola be appointed to the Board of Directors in accordance with Council Policy I-115 (Appointments - Board of Directors - Kitchener Power Corporation)." Carried. Council was in receipt of a letter from Ms. Karen Kwiatkowski, General Manager, Kitchener Housing Inc., requesting that Council consider the appointment recommendation of the Board of Directors. Councillor G. Lorentz suggested that there is a need for more citizen involvement on the Kitchener Housing Inc. Board of Directors rather than the current number of Councillors. It was also suggested that there may be a need for staff representation on the Board. Moved by Councillor G. Lorentz Seconded by Councillor B. Vrbanovic "That Mayor C. Zehr and Councillor C. Weylie be appointed to the Kitchener Housing Inc. Board of Directors; and, NOVEMBER 4, 2002 SPECIAL COUNCIL MINUTES - 432 - CITY OF KITCHENER That Mr. Jerry Finnen and Ms. Birgit Heilig be appointed for a three-year term; and, That the Board of Directors of Kitchener Housing Inc. be requested to amend its by-law to reflect a reduction in Council representation and the possible need to increase citizen representation in order to maintain quorum; and further, That the General Manager of the Development & Technical Services Department be directed to discuss with Kitchener Housing Inc. the possibility of having City staff appointed to the Board of Directors." Carried. In considering appointments to various community Boards and Committees, Council agreed that: appointment to the Citizen's Advisory Committee on Air Quality be referred to the Environmental Committee with respect to making an appointment; that Council decline any further appointment to the Folk Arts Multicultural Centre Festival Committee; and, that no appointment be made at this time to the K-W Symphony Board of Directors. Mayor C. Zehr advised of two additional items for the in-camera agenda, a personal matter and potential litigation matter and a matter subject to solicitor-client privilege. Moved by Councillor B. Vrbanovic Seconded by Councillor G. Lorentz "That Council meet in-camera immediately following this special meeting to consider a land acquisition matter, three personal matters, a potential litigation matter and three matters subject to solicitor-client privilege."
