McBride Stephanie Brasseur All May 18, 2007 DTS 07-087 Subject: ROAD AND SURFACE CONSTRUCTION NOISE EXEMPTION FOR CITY OF KITCHENER CONTRACT T07-002 RECOMMENDATION: That the City of Kitchener and its contractor(s~ be exempt from the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work during the Road and Surface Construction Contract #T07-002 in the City of Kitchener. The request for the noise by-law exemption is only between the hours of 7:00 p.m. to 9:00 p.m. for the period from April 30, 2007 to September 28, 2007. BACKGROUND During our preconstruction meeting for the Roads and Surface Construction Contract of April 26, 2007, the contractor, Steed and Evans Ltd requested an exemption be granted to the noise bylaw. In order to complete the work and minimize traffic disruption for these projects, and the fact that various roadways are affected throughout the contract, some weekend work may be required in order to complete the project in the time allotment. This exemption is requested in order to work until 9:00 p.m. as required to complete the work, and the contractor will advise in advance of any required weekend work. The noise exemption request primarily includes the need for evening work to complete work and ideally clean up the site and perform paving operations. As well, some arterial roads have been added to this contract in cooperation with the Regional Municipality of Waterloo (i.e. Victoria Street South surface works from Walnut Street to Lawrence Avenue). This exemption will incorporate the work to minimize intersection closure times and improve traffic flows once the work has been completed. Noise protocol will be followed, which covers administrative measures such as scheduling of noisy activities at times of least impact, selection of haulage routes to minimize close proximity to neighbours, and maintaining contact with residents. The request for a noise exemption will permit the City of Kitchener and its Contractor(s) to complete their work in a safe and efficient manner under the limit set out in the contract. In order to limit the impact on the nearby residential areas, the contractor will be required to comply with requirements for equipment maintenance and operation, in that the contractor is obligated to maintain all equipment in proper working order including proper noise reduction. In order to expedite the construction and allow extended hours of work to take place for this project, thereby minimizing traffic impacts, we recommend that this request for a noise by-law exemption be granted.
