Gosse, Director of Legislated Services/City Clerk Prepared By: Patricia Harris, Manager of Licensing Wards} Involved: 1 Date of Report: May 14, 2007 Report No.: CRPS-07-066 Subject: LICENSING HEARING -GAZA BACHA SPA -195 VICTORIA STREET NORTH RECOMMENDATION: That the Manager of Licensing's decision to refuse the application of Jamilah Sulema Musein to operate an alternative massage centre at 195 Victoria Street North, Kitchener, Ontario be confirmed. BACKGROUND: An application to operate an alternative massage centre has been received by the Manager of Licensing for Jamilah Sulema Musein .The applicant wishes to operate her business at 195 Victoria Street North under the business name of Caza Bacha Spa. This applicant is currently licenced as a Permanent Vendor by the City of Kitchener to offer cosmetic and electrolysis services. Alternative massage includes the kneading, manipulating, rubbing, massaging, touching or stimulating by any means, of a person's body, but does not include services designed to appeal to erotic or sexual appetites or inclinations and does not include medical or therapeutic treatment performed or offered by persons qualified, licensed or registered under the laws of the Province of Ontario. REPORT: Schedule `A' -Business Licence Procedure of Chapter 508 (Alternative Massage Centres) of the Kitchener Municipal Code states in Section 3(d) "The Manager of Licensing shall not process an application where that application is incomplete. An application will be deemed incomplete where the Manager of Licensing has received an unsatisfactory report regarding an investigation carried out pursuant to Chapter 500 of the City of Kitchener Municipal Code or any other by-law of the City and the conditions causing the report to be unsatisfactory have not been remedied. It also states in Section 7(c) that the past or present conduct of any person, including the officers, directors, employees or agents of a corporation, affords reasonable cause to believe that the person will not carry on or engage in the business in accordance with the law or with honesty and integrity and 7~f} the provisions of this Chapter provide grounds not to issue or renew in the circumstances. The Manager of Licensing has received information from an officer of the Waterloo Regional Police that during a police investigation he was able to make arrangements for a massage which included sexual services. Caza Bacha Spa is also listed on an adult services web site offering massages. Based on that information, the Manager of Licensing determined that the application for an alternative massage centre should be refused. COMMUNICATIONS: The applicant has received a copy of this report and been informed of the date and time of the Finance and Corporate Services Committee meeting.
