Subject: ENCROACHMENT AGREEMENT REQUEST - PROPOSED
SIDEWALK AT 7 UPPER MERCER ST.

"That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory
to the City Solicitor, with the property owner of Block 29, Registered Plan 58M-392, municipally
known as 7 Upper Mercer St., to legalize the installation of a 1.5m sidewalk for a length of
approximately 21 m on City property."

As part of the site plan approval for the townhouse development proposed at 7 Upper Mercer
St-5 it is a requirement that the site have two accesses. The access in question has insufficient
width to accommodate both two-way vehicular traffic and a pedestrian sidewalk entirely on the
owners property. Thus, the sidewalk is proposed to be located on City property zoned R6,
described as Block 33 on Registered Plan 58M-392. The location is set out on the attached
drawing. The proposed sidewalk will be 1.5m wide, will run a length of approximately 21 m on
City property and will connect to the City sidewalk on Upper Mercer St.
The owner of 7 Upper Mercer St. is responsible for construction and maintenance of the
sidewalk.
FINANCIAL IMPLICATIONS:
N/A
The appropriate staff has reviewed this request and has no concerns with the location of the
proposed installation of the sidewalk.
