Gosse 2 June 15, 2007 CRPS-07 -092 ADJOURNMENT OF LICENSING TRIBUNAL - ROXXANNE'S RECOMMENDATION: That the licensing hearing in the matter of business licence No. 20 07 1 05538 00 L6, issued to 1685000 Ontario Ltd. operating as Roxxanne's Bar and Grill scheduled for June 28, 2007, be adjourned to September, 2007 on a date to be determined; and further, That the expiry date for business licence No. 20 07 1 05538 00 L6 be extended to September 30, 2007. BACKGROUND: On February 19, 2007, Council adopted a motion to refer the application for a 2007 Class E Adult Entertainment Parlour licence submitted by 1685000 Ontario Ltd. operating as Roxxanne's Bar and Grill, to a licensing tribunal. A date for the tribunal has been set for June 28, 2007. In a letter dated June 15, 2007 the lawyer representing the owners of Roxxanne's has requested that the tribunal be adjourned in light of a recent motion filed in the courts. REPORT: In addition to the licensing hearing for Roxxanne's, Council also adopted a motion to refer the licence application submitted by 2027625 Ontario Ltd. operating as The Doll House to a separate tribunal. Prior to that hearing date (June 20, 2007), lawyers for The Doll House filed a motion with the courts in regard to the City's Adult Entertainment By-law. The judge dealing with the motion has ordered that it be heard on September 6, 2007 and the City's tribunal shall be held following the court date and on or before September 30, 2007, or such later date at the discretion of the tribunal. The lawyer representing Roxxanne's has requested a similar adjourn for his client. Staff have reviewed the request and in consideration of the fact that the by-law under which the tribunal will be held for Roxxanne's is the subject of a motion before the courts, it would be prudent to adjourn this hearing until after September 6, 2007. The current licence issued to Roxxanne's expires June 30, 2007 therefore, should Council agree to the adjournment, the current licence must be extended. It is being recommended that the licence be extended to September 30, 2007 to ensure that the hearing takes place as soon as possible following the court date of September 6.
