Execution of Record of Site Condition documentation
pertaining to any City owned lands
RECOMMENDATION:
That the Mayor and Clerk be authorized to execute, on behalf of The Corporation of the City of
Kitchener, as owner, any documentation, necessary as part of the Record of Site Condition
process, as set out in Ontario Regulation 153/04 or its successor, for any lands owned by The
Corporation of the City of Kitchener, said documentation to be satisfactory to the City Solicitor.
EXECUTIVE SUMMARY:

BACKGROUND:
From time to time, as owner of land, the City of Kitchener requires and/or desires a Record of
Site Condition for various parcels of City owned land.
REPORT:
In order to secure a Record of Site Condition pertaining to parcels of City owned land, it is
necessary that the City retains services of an Environmental Consultant to complete the
necessary environmental site assessment and secure a Record of Site Condition for the
property. As the property owner, the City of Kitchener is expected to execute various
documentation as part of the Record of Site Condition submission process. So as not to delay
the submission of various documentation under the Record of Site Condition process as they
may arise, it is appropriate to delegate to the Mayor and Clerk general authority to sign as
representatives of the owner, any Record of Site Condition documentation that may be

necessary for any lands owned by the City of Kitchener. This will include but not be limited to
the presubmission form, risk assessment application, and the Record of Site Condition affidavit.
FINANCIAL IMPLICATIONS:
There are costs in conducting environmental assessments and preparing the documentation to
submit for Record of Site Condition purposes which are typically acknowledged as part of the
overall project for a specific site.

CONCLUSION:
It is appropriate for the Mayor and Clerk, on behalf of The Corporation of the City of Kitchener,
as owner of the land to execute any documentation necessary as part of the Record of Site
Condition process.
The establishment of this authority on a generic basis allows for the timely execution of any
documentation which may be necessary for City owned lands which are subject to the Record of
Site Condition process.
