The Heritage Kitchener Committee met this date, commencing at 4:05 p.m.

1. DTS-07-091 -HERITAGE PERMIT APPLICATION HPA 2007-V-004

- DEMOLITION OF EXISTING GARAGE & CONSTRUCTION OF
REPLACEMENT GARAGE
Mr. K. Kirby declared a conflict of interest as he resides on Seneca Drive and accordingly, did
not participate in any discussion or voting with regard to this matter.
The Committee was in receipt of Development and Technical Services Department report
DTS-07-091, dated May 23, 2007 regarding Heritage Permit Application HPA 2007-V-004,
concerning the demolition of the existing garage and construction of a replacement garage at
20 Seneca Drive, which is located within the St. Mary's Heritage Conservation District (HCD).
Ms. S. Barber advised that the existing garage is a one storey frame structure with afront-
gabled roof and vertical wood siding. She stated that the applicant wishes to demolish the
garage and replace it with a new one similar to the original in size, shape and height. The
current garage is 10 feet wide and 20 feet long and the proposed new garage will be 12 feet
wide and the same length as the existing. She noted that though original to the subdivision, the
existing garage is in very poor condition. The owner is of the opinion that it is too cost
prohibitive to restore. The proposed new garage will be similar to the existing garage in size,
shape and height. Staff are of the opinion that the demolition of the existing garage and the
construction of the proposed new garage will not have an adverse impact on the character of
the Heritage District. Accordingly, staff recommends approval of HPA 2007-V-004.
Mr. L. Bensason advised that the existing garage is presently situated 5 inches inside of the
property line. The new structure will be located four feet inside the property line to conform to
the current zoning requirements. He added that an Order to Comply with Chapter 665 of the
Municipal Code (Property Standards) has been issued against the existing garage.
Mr. L. Robertson expressed concern with the proposed design of the new garage and noted
that the elevation drawings attached to the HPA are inconsistent with what has been
proposed. In addition, he expressed concerns that the proposed garage would not resemble
the original, particularly the inclusion of the air vent and the gable returns.
Mr. Sandy Paterson, Applicant, advised that the drawing for the new garage was taken from a
Rona Flyer and while it may not be an accurate representation, the dimensions outlined in the
HPA are correct. He added that in terms of the shape of the garage, the pitch of the roof and
colour are consistent with the drawings.
On motion by Mr. J. Ariens -
it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2007-V-004 (20 Seneca Drive) be approved, to permit the demolition of the
existing garage and the construction of a new garage, subject to the design of the new
garage shown in the plans attached to the application being modified through the
removal of the return eaves and gable vent detail."

- 35 ST. CLAIR AVENUE, ST. MARY'S HERITAGE CONSERVATION
DISTRICT
- PROPOSED CONSTRUCTION OF REARISIDE ADDITION
The Committee was in receipt of Development and Technical Services Department report
DTS-07-090, dated May 29, 2007 regarding Heritage Permit Application HPA 2006-V-014
concerning the proposed construction of rear/side addition at 35 St. Clair Avenue, which is
located within the St. Mary's Heritage Conservation District (HCD).
Ms. S. Barber advised that the subject HPA was received in August 2006 and at that time the
applicants did not have an architect or contractor to prepare a concept or measured drawings.
As a result, the applicants submitted a request for an extension of the 90 day timeframe to
process the application. Council granted the extension in February, 2007 and a subsequent
extension request was granted to June 30, 2007. She noted that due to a death in the family
the property owners were unable to attend this meeting. Ms. Barber stated that the proposed
addition complies with the St. Mary's HCD Plan policies with respect to height and location as
it would be lower than the main house. She noted that although visible from the public realm
the addition would be located as far to the rear of the house as possible, attached mainly to
the rear addition and is designed to blend in with the main house. She added that the
proposed mud room addition would not adversely impact the heritage character of the existing
house or the surrounding area and accordingly, staff recommends approval of HPA 2006-V-
014.
Mr. L. Robertson expressed concerns with the proposed design of the addition's roof slopping
on an angle back into the house. He stated that in his opinion alean-to shed roof would be
more in keeping with the heritage character of the HCD.
On motion by Ms. L. Brohman -
it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2006-V-014 (35 St. Clair Avenue) be approved, to permit the construction of a
mud room addition to the rear/side of the existing dwelling, subject to the design of the
addition being modified to provide for alean-to or shed style roof, rather than a gable
roof as shown in the plans submitted with the application."
3. PRESENTATION - DOON SOUTH COMMUNITY UPDATE
- STATUS OF GROH DRIVE AS A SCENIC ROAD & REVIEW OF
HERITAGE FEATURES
The Committee was in receipt of a memorandum from Ms. Della Ross, Manager of
Development Review, dated May 24, 2007 regarding the draft Doon South Community Plan
and a review of heritage features to support Groh Drive's status as a scenic road.
Ms. D. Ross advised that in June 2004 this Committee provided feedback on the Doon South
Community Plan, however, a servicing study needed to be completed which delayed
consideration of the Community Plan. She noted that the servicing study has been completed
so that consideration of the Community Plan can continue and members were requested to
provide feedback on the updated Community Plan.
Mr. Pierre Chauvin, MHBC Planning, gave a presentation on the draft Doon South Community
Plan. He advised as to the location, content and purpose of the plan and spoke specifically to
the following:
• how heritage features have been protected as part of the recommended collector road
network;
• the status of Groh Drive as a scenic road in context of the approved City of Kitchener
Municipal Plan; and,
• reviewed a proposed Municipal Plan Amendment emphasizing the further designation of
Groh Drive as a scenic road.

In response to questions, Mr. P. Chauvin advised that the school house at the corner of Dodge
Drive and Groh Drive will remain undisturbed under the revised Plan. It was noted that by and
large the overall Community Plan remains unchanged from the 2004 document and the only
area being impacted as a result of the revisions is the southern portion of the community.
Mr. L. Bensason advised that as part of his review of the draft Plan he will examine the
potential impact it may have on all heritage properties in the Doon South area. He stated that
two properties on New Dundee Road and several others on Dodge Drive have been identified
as potentially being of cultural heritage value or interest and will be reviewed at the next
Municipal Heritage Register 2007 Evaluation Subcommittee meeting. Mr. Bensason advised
that if any members had any further comments regarding the draft Community Plan that they
could forward those to him or Ms. Ross directly.
4. DTS-07-092 - 72 VICTORIA STREETH SOUTH
- WITHDRAWAL OF NOTICE OF INTENT TO DESIGNATE
The Committee was in receipt of Development and Technical Services Department report
DTS-07-092, dated May 30, 2007 regarding the withdrawal of the Notice of Intent to designate
72 Victoria Street South under Part IV of the Ontario Heritage Act.
At the request of staff, consideration of this matter was deferred until the September 4, 2007
Heritage Kitchener meeting.
5. PRESENTATION - 1094 DOON VILLAGE ROAD
Mr. L. Bensason advised that the owners of 1094 Doon Village Road, which is located within
the Upper Doon Heritage Conservation District (HCD), have informed staff that some time in
the near future they may request approval for the demolition of the existing building and the
construction of a replacement building. He added that prior to making those applications and
hiring an architect to draft plans for the new building the owner has requested that staff solicit
comments from this Committee to gauge the level of support and / or identify any concerns the
members may have regarding this proposal. Mr. Bensason stated that the Upper Doon HCD
Plan categorizes buildings as either A or B, depending on historic significance, adding that
buildings with an A classification have historic value and B buildings do not. He noted that
even though it may have been constructed in 1885 and associated with the Brine Mill Village,
the house at 1094 Doon Village Road is classified as a B building. He stated that this is due to
the extensive alterations and additions that have been made to the building and as there is no
clear evidence that the structures original building material still exists. He noted that the owner
is aware that design for any new building is subject to the Upper Doon HCD guidelines.
In response to questions, Mr. L. Bensason advised that the owner has indicated a preference
to locate the new building in the same location as the existing building. He added that the
house is also set-back from the road and surrounded by contemporary homes.
The Committee agreed that they have no objection with the proposed demolition of the
existing house at 1094 Doon Village Road, provided the plans for the new building are
provided to the Committee at the same time that they consider the demolition permit
application.
6. GENERAL DISCUSSION -COMMITTEE MEMBERS WORKLOAD
Councillor J. Gazzola advised that this item was added to the agenda in response to concerns
raised by Ms. E. Gallaher regarding the work load that will be required of the members over
the next year. A brief discussion ensued and several members advised that they do not feel
that the work load has been or will be onerous.

7. ANTICIPATED HERITAGE PERMIT APPLICATION FOR 307 QUEEN STREET SOUTH
tBREAD AND ROSES) -PROPOSED METAL CLADDING OF WINDOWS AND SILLS
Mr. L. Bensason advised that he was recently contacted by the consultant who initially
presented the draft plans for the proposed metal cladding of the windows and sills at 307
Queen Street South (Bread and Roses) at the June 6, 2006 Heritage Kitchener meeting. He
stated that the consultant informed him that they are in the process of finalizing their plans and
wished to review the details with him over the summer months. Mr. Bensason noted that
typically he would invite the member representative from the affected Heritage Conservation
District (HCD) to evaluate these types of plans with him, but unfortunately the Committee
currently does not have anyone appointed to represent the Victoria Park HCD. Mr. Bensason
requested a volunteer to assist him in reviewing the revised plans.
Following a brief discussion, the Committee agreed to appoint Mr. I. Mota as its representative
for the Victoria Park HCD and to assist Mr. Bensason in reviewing the revised plans.
