The request for the noise by-law exemption is between the hours of 7:00 p.m. to 7:00 a.m. for the period from July 7, 2007 to July 8, 2007 or a rain date of July 28, 2007 to July 29, 2007. BACKGROUND: John Lee, Project Manager for the Regional Municipality of Waterloo, sent an email request dated June 1, 2007 for an exemption to be granted to the noise bylaw. In order to complete the work and minimize traffic disruption for this project, weekend work must take place in order to complete the project causing minimal disturbance to the public. This exemption is requested in order to work until Sunday July 8, 2007, as required to complete the work. REPORT: The limits of construction for this project include the intersection of Ottawa Street South and Homer Watson Boulevard in the City of Kitchener. This project will commence on July 7, 2007 at 7:00 p.m. and is scheduled to continue until completion on July 8, 2007. The noise exemption request includes the need for one (1) weekend of work during the construction period. This will incorporate the work within the intersection to minimize intersection closure times and improve traffic flows once the work has been completed. The weekend is scheduled as July 7 and 8, 2007 at the intersection of Homer Watson Boulevard and Ottawa Street South, for repaving. Homer Watson Boulevard will be closed at 7:00 p.m. Saturday July 7, 2007 while Ottawa Street will remain open with one (1) lane of traffic in each direction. Sunday July 8, 2007, the intersection of Homer Watson Boulevard and Ottawa Street will have a full road closure. Noise protocol will be followed, which covers administrative measures such as scheduling of noisy activities at times of least impact, selection of haulage routes to minimize close proximity to neighbours, and maintaining contact with residents/businesses. The request for a noise exemption will permit the Regional Municipality of Waterloo and its Contractor(s) to complete their work in a safe and efficient manner under the limit set out in the contract. In order to limit the impact on the nearby residential areas, the contractor will be required to comply with requirements for equipment maintenance and operation, in that the contractor is obligated to maintain all equipment in proper working order including proper noise reduction. FINANCIAL IMPLICATIONS: None. COMMUNICATIONS: The Regional Municipality of Waterloo and its contractor will communicate the expectation of extended working hours to area businesses and have been actively advising of any changes as they develop. CONCLUSION: In order to expedite the construction and allow extended hours of work to take place for this project, thereby minimizing traffic impacts on Homer Watson Boulevard and Ottawa Street South, we recommend that this request for a noise by-law exemption be granted.
