Date of Report: June 11, 2007
Report No.: DTS-07-108
Subject: SUNNY MEADOW COURT SIDEWALK EXEMPTION
REQUEST
RECOMMENDATION:
A) That Council continue to endorse sidewalk installation which supports the
Pedestrian Charter and the principles of accessibility, equity, health and well-being,
environmental sustainability, personal and community safety and community
cohesion and vitality which are used to ensure walking is a safe, comfortable and
convenient mode of urban travel, and further
B} That the sidewalk on Sunny Meadow Court be installed in accordance with the
registered subdivision agreement.
REPORT:
A petition was received in late May 2007 by the Engineering Services Division from Mr. Jorge
Silveira of 225 Sunny Meadow Court in Kitchener. The petition contains fourteen (14) signatures
of interested residents from seven (7) different properties out of fourteen (14) that are on this
street. These residents are requesting that the proposed sidewalk be eliminated as they feel
that it takes away from the curb appeal of the properties.
Staff has reviewed the request and do not support it for the following reasons:
1. Pedestrian Charter; Council has re-affirmed its position that all streets should have
sidewalk to promote pedestrian uses and,
2. The registered subdivision agreement, which was approved by Council, clearly indicates
that sidewalks are to be installed in this plan with the cost being borne by the developer
and,
3. If in the future it was determined that sidewalk needed to be installed then it would have
to be done at the City's expense.
FINANCIAL IMPLICATIONS:
None
COMMUNICATION:
There has been no formal public process to date on these matters.
CONCLUSION:
That Council continue to endorse sidewalk installations which support the Pedestrian Charter
and the principles of accessibility, equity, health and well-being, environmental sustainability,
personal and community safety and community cohesion and vitality which are used to ensure
walking is a safe, comfortable and convenient mode of urban travel.
