RECOMMENDATION:
That Zone Change Application ZC07/10/K/JB (401 King Properties Ltd) for the purpose of
changing the zoning from Warehouse District Zone (D-6) with Holding Provision 9H and Special
Use Provision 138U to Warehouse District Zone (D-6) with Special Use Provision 138U on
lands legally described as Plan 374 Lot 118, Pt Lots 56-58, 110-117, 119 and Pt of Lane RP
374 RP 58R-14293 Pt 11 RP 58R-14771 Pts 1 & 2 in the City of Kitchener be approved in the
form shown in the Proposed By-law dated June 14, 2007 but should not receive three
readings at council until the City is in receipt of the letter from the Ministry of the Environment
indicating that they have no concerns with the removal of the Holding Provision.
BACKGROUND:
The subject lands are located at 410 King Street West. The applicant is proposing to rezone the
property for the purpose of removing Holding Provision 9H. Holding Provision 9H was placed
on the property through a previous rezoning and the Provision requires that the City receive a
letter from the Ministry of the Environment advising that the Ministry is satisfied with allowing
residential use on the property. The City of Kitchener has received verbal confirmation from the
Ministry of the Environment that the Holding Provision can be lifted and are awaiting written
confirmation. The removal of the 9H would allow the development of the property for residential
use.
REPORT:
The City of Kitchener is expecting the imminent arrival of confirmation from the Ministry of the
Environment indicating that the Ministry is satisfied with allowing a residential use on the lands
legally described as Plan 374 Lot 118, Pt Lots 56 -58, 110 -117, 119 and Pt of Lane RP 374 RP
58R -14293 Pt 11 RP 58R -14771 Pts 1 & 2 in the City of Kitchener.
FINANCIAL IMPLICATIONS:
No new or additional capital budget requests are expected with this recommendation.
COMMUNICATIONS:
A newspaper ad was published in the KW Record on May 28, 2007 to give notice of the public
meeting to be held by the City's Development and Technical Services Committee on Monday,
June 18, 2007.
CONCLUSION:
Based on the foregoing, the Department of Development and Technical Services recommends
that Zone Change Application ZC07 /10 /K /JB for lands at 410 King Street West be approved in
the form shown in the Proposed By -law dated June 14, 2007 but should not receive three
readings at council until the City is in receipt of the letter from the Ministry of the Environment
indicating that they have no concerns with the removal of the Holding Provision.

CORPORATION OF THE CITY OF KITCHENER
(Being a by -law to amend By -law 85 -1, as amended,
known as the Zoning By -law for the City of Kitchener
— 410 King Properties Ltd — 410 King Street West)
WHEREAS it is deemed expedient to amend By -law 85 -1;
NOW THEREFORE the Council of The Corporation of the City of Kitchener
enacts as follows:
1. Schedule 84 of Appendix "A" to By -law Number 85 -1 is hereby amended by
day of
deleting the holding symbol and numerical reference thereto (9H) as such symbol
and numerical reference relate to the lands described as Plan 374 Lot 1181 Pt
Lots 56 -58, 110 -1171 119 and Pt of Lane RP 374 RP 58R -14293 Pt 11 RP 58R-
14771 Pts 1 & 2 in the City of Kitchener. These lands are shown on Map No. 1
attached hereto.
