RECOMMENDATION:
That Zone Change Application ZC07/08/B/LT (61 & 63 Becker Street -Henry Walser
Funeral Home) for the purpose of changing the zoning from Residential Six Zone (R-6) to
Residential Six Zone (R-6) with special use provision, 362U, to permit a parking lot for the
Walser Funeral Home on the lands legally described as Part of Lots 27, 28, 29 and 30,
Registered Plan 42, Part 1, Reference Plan 58R-15854 in the City of Kitchener, be
approved in a form shown in the attached "Proposed By-law" dated June 22, 2007,
without conditions.
BACKGROUND:
The subject property is located on the south-west side of Becker Street, and has recently been
severed from a larger parcel containing two multiple residential buildings. The site is across the
street from the Walser Funeral Home. The owner has applied for the zone change to develop a
future parking lot for the Walser Funeral Home. The zone change is required to permit the use
of `commercial parking facility' on the property.
REPORT:
1. Planning Comments
The applicant is proposing to change the zoning from Residential Six Zone (R-6) to Residential
Six Zone (R-6) with special use provision 362U to permit the use of `commercial parking facility'
on the property. The property is designated as Mixed Use Node in the City's Municipal Plan.
The Mixed Use Node designation is intended to provide a balance of commercial, multi-
residential and institutional uses that are compatible with the surrounding Low Rise Residential
development. The proposed use of the property as a commercial parking facility for the existing
funeral home use is in keeping with the types of commercial uses outlined in the Mixed Use
Node designation.
The location of the subject property is at the dead end of Becker Street and is bounded by
single detached dwellings across the street to the east, multiple dwellings to the south and the
KW Expressway to the west. The site is across the street and slightly south of the Walser
Funeral Home. Approving the zone change for the subject property is appropriate to permit the
development of additional parking for the funeral home.
The land which is the subject of this zone change application is appropriate to rezone for a
commercial parking facility due to its proximity to the existing funeral home. The parcel of land
was not required for the residential use it was severed from and in the future if the funeral home
no longer requires this land for additional parking it can return to a residential use.
The owner will be required to obtain site plan approval and a Building and Land Use Permit from
the Ministry of Transportation to develop the commercial parking facility. In order to ensure
adequate off-street parking is available for patrons of the funeral home, the owner has
purchased this portion of 61 & 63 Becker Street for a parking lot. It should be noted that the
proposed additional parking to be developed on the subject property is not required parking
under the City of Kitchener Zoning By-law, but rather additional parking that the owner
recognizes a need for. By providing the additional parking for patrons, the demand for on-street
parking in the neighbourhood should be significantly reduced.
2. Property Owner Comments
Four responses were received from the neighbourhood circulation. All responses were in favour
of the proposed zone change.
3. Department/Agency Comments
There were no concerns or objections to this application from any departments or agencies.
FINANCIAL IMPLICATIONS:
None.
COMMUNICATIONS:
Preliminary circulation of the zone change application was undertaken on May 9, 2007 to all
departments/agencies and to all property owners within 120 metres of the subject lands. As a
result of the preliminary circulation, staff received four favourable responses from neighbouring
property owners.
Notice of the August 13, 2007 public meeting of the Development and Technical Services
Committee was advertised in The Record on July 20, 2007. A copy of the advertisement is
attached.
CONCLUSION:
In summary, the Department of Development and Technical Services recommends that Zone
Change Application ZC07/08/B/LT be approved in the form shown in the Proposed By-law
without conditions.

OF THE
CORPORATION OF THE CITY OF KITCHENER
(Being a by-law to amend By-law 85-1, as amended, known
as the Zoning By-law for the City of Kitchener -Henry
Walser Funeral Home -Becker Street)
WHEREAS it is deemed expedient to amend By-law 85-1;
NOW THEREFORE the Council of The Corporation of the City of Kitchener enacts as
follows:
1. Schedule 140 of Appendix "A" to By-law Number 85-1 is hereby amended by
designating as Residential Six Zone (R-6) with Special Use Provision 362U instead of
Residential Six Zone (R-6), the parcel of land described as Part of Lots 27, 28, 29 and
30 Registered Plan 42, being Part 1 on Reference Plan 58R-15854, in the City of
Kitchener. These lands are shown on Map No. 1 attached hereto.
2. Schedule 140 to Appendix "A" to By-law 85-1 is hereby further amended by adjusting
the zone boundaries as shown on Map 1 attached hereto.
3. Appendix "C" to By-law 85-1 is hereby amended by adding Section 362 as follows:
"362 Notwithstanding Section 40.1 of this By-law, within the lands zoned R-6 as shown
on Schedule 140 of Appendix `A' and described as Part of Lots 27, 28, 29 and 30,
Registered Plan 42, being Part 1 on Reference Plan 58R-15854, a commercial
parking facility associated with a funeral home establishment located on Part Lots
8 to 12 inclusive, Registered Plan 42 shall also be permitted."
