Subject: EXEMPTION TO CHAPTER 450 (NOISE) -CIVILIAN
PRINTING, 8 DUKE STREET EAST
RECOMMENDATION:
That an exemption to Chapter 450 (Noise} of the City of Kitchener Municipal Code be granted to
Civilian Printing at 8 Duke Street East, on September 15, 2007, between the hours of 1:00 P.M.
and 11:00 P. M., for an outdoor street concert.
BACKGROUND:
Mr. Cory Grossman is requesting an exemption to Chapter 450 (Noise} of the City's Municipal
Code for an outdoor street concert to be held on Duke Street East, on September 15, 2007,
between the hours of 1:00 P.M. and 11:00 P.M.. A copy of his request is attached.
REPORT:
Mr. Grossman has applied for a street closure permit which is currently in process. Given that
this is a first time event, it is difficult to gauge what potential impact any resulting noise may
have on adjacent neighbourhoods. However, the nature of this event is somewhat similar in
nature to other events previously approved in the downtown area.
Mr. Grossman indicates that the music will start at approximately 2:00 P.M. and is scheduled to
end at 10:00 P.M.. The extra 1 hour is being requested to accommodate the stage take-down,
etc..
Mr. Grossman has also indicated that this event is being used to promote businesses along
Duke Street. As a result, neighbouring property owners are being advised of the event.
FINANCIAL IMPLICATIONS:
None identified at this time.
COMMUNICATIONS:

CONCLUSION:
Based on the circumstances surrounding this request, the By-law Enforcement Division does
not object to this request for an exemption.
