CITY OF KITCHENER
A special meeting of City Council was held at 4:55 p.m. this date, Chaired by Mayor C. Zehr and with all
members present except Councillor M. Galloway.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Development & Technical Services Department report DTS-02-258 (M.
Henderson), dated November 13, 2002, recommending that Council approve an exemption from
Chapter 450 (Noise) of the Municipal Code.
Moved by Councillor B. Vrbanovic
Seconded by Councillor C. Weylie
"That Council approve an exemption from Chapter 450 (Noise) of the Municipal Code to permit
the night-time CCTV and sewer flushing work required on King Street and on Water Street
between Ottawa Street and Victoria Street, occurring occur between the hours of 6:00 p.m. and
7:00 a.m. starting November 19, 200 and ending on November 29, 2002; and further,
That this work is being completed under Contract T02-030 - Closed Circuit T.V. Inspection of
Gravity Sewers."
Carried.
Mayor C. Zehr requested that Council consider a matter not listed on the special Council agenda and of
an urgent nature regarding electricity rates.
Moved by Councillor J. Smola
Seconded by Councillor B. Vrbanovic
"That pursuant to Chapter 25 (Council Procedure) of the Municipal Code, the following urgent
mater be added to the agenda of the special meeting of Council this date: pending Provincial
legislation regarding electricity rates."
Carried with required 2/3 majority.
Mayor Zehr advised of the Province's intention to introduce legislation concerning electricity rates which
may have a direct impact on Kitchener-Wilmot Hydro and the City. He suggested that the Province must
be made aware of the possible financing implications the legislation may have on municipalities and the
need to consult with all stakeholders within the Province.

Seconded by Councillor B. Vrbanovic
"WHEREAS the Province of Ontario announced its intention to introduce legislation to mitigate
the increases in electricity rates (largely caused by steep increases in commodity prices); and,
WHEREAS several of the contemplated changes could have long term and significant impacts
on the Province of Ontario, Ontario municipalities, including the City of Kitchener, and local
distribution companies, including Kitchener-Wilmot Hydro; and,
WHEREAS the current organization and corporate structures were very costly to establish
under Provincial and Ontario Energy Board (OEB) regulations; and,
WHEREAS the entire electricity market and system, along with the Municipal structure, are
very complex and impact one another; and,
WHEREAS Municipalities have already had public input and debates regarding the ultimate
corporate structure chosen within the guidelines as set out by the Province and the OEB;
THEREFORE BE IT RESOLVED that the City of Kitchener urgently request the Province of
Ontario to consult widely and fully with the Municipalities within Ontario as well as the

Association of Municipalities of Ontario, regarding the draft electricity legislative changes in
order to consider the different circumstances throughout the Province;
AND FURTHER that a copy of this resolution be forwarded to the Premier of Ontario, the
Minister of Energy, local MPPS and the Association of Municipalities of Ontario."
Carried.
Mayor C. Zehr advised of one additional item for in-camera discussion this date involving a matter
subject to solicitor-client privilege.

Seconded by Councillor C. Weylie
"That an in-camera meeting of City Council be held this date to consider two land acquisition
matters, two personal matters, two labour relations matters and four matters subject to
solicitor-client privilege."
Carried.
The meeting then recessed at 5:04 p.m. and re-convened at 8:29 p.m., Chaired by Mayor C. Zehr
and with all members present.
Council considered a recommendation approved at the Development & Technical Services
Committee meeting this date dealing with the Direct Detect In-Home Fire Monitoring System.
Moved by Councillor C. Weylie
Seconded by Councillor B. Vrbanovic
"That the Mayor and Clerk be authorized to sign an agreement, satisfactory to the City
Solicitor, with AES IntelliNet (AES Corporation) regarding the purchase of its wireless and
towerless alarm monitoring hardware and use of its software as set out in DTS Report 02-257
dated November 18th, 2002; and,
That staff be authorized to procure for the City the goods and services of AES IntelliNet for the
purpose of providing a networked long-range radio frequency data communications system
which meets and exceeds the requirements of UL-AA, ULC and NFPA 72 for life safety
communications for the Kitchener Fire Department and the delivery of the Direct Detect fire
detection system and hereby waives the requirement under Chapter 170 of the City of
Kitchener Municipal Code to call for expressions of interest; and,
That the cost of the primary and secondary central alarm monitoring stations not exceed
$35,000.00 including all taxes and these funds be drawn from Account 412057-1580; and
further,
That the cost of the premise hardware defined in the agreement with AES be recovered
through purchase, rental or annual fees from the end users."

"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2002-213 by the Clerk."
Carried.
On motion, the meeting adjourned at 8:30 p.m.
