Date of Report: September 4, 2007
Report No.: CRPS-07-120
Subject: APPEAL- HOT DOG LOCATION - 90 ARDELT AVENUE
RECOMMENDATION:
The Committee's direction is requested.
BACKGROUND:
Chapter 586 (Refreshment Vehicles) of the City of Kitchener Municipal Code requires a 200
metre distance separation between a Refreshment Vehicle and a Place of Refreshment and a
400 metre distance separation between two Refreshment Vehicles. This requirement is for both
new and renewal applications.
REPORT:
Attached is a letter from Vlasta Kadlec requesting an appeal of the Manager of Licensing's
decision not to issue a licence for the operation of a hot dog cart at 90 Ardelt Avenue. She has
received permission from the operator of the business located at this address and has
canvassed other businesses in the area to enquire if they have any objections.
Transportation Planning has reviewed the proposal and they require that the hot dog cart,
including customer parking, must be located entirely on private property.
There is currently one Place of Refreshment within the distance separation. They have been
notified of this request.
FINANCIAL IMPLICATIONS:
None
COMMUNICATIONS:
The Place of Refreshment that is within the distance separation has been notified of this
request.
